Default Quick Capital One MCOL Question

Hi,

I followed the order of letters etc and have now filed my first MCOL against Capital One. I copied the Particulars of claim from this site and it says in them that schedule of charges being claimed have already been sent and that a further copy would be sent.

I have no problem sending this off at all (they already have my original sheet but this was without the interest).

Is it ok to send them the charges I am claiming again plus the interest this time? Will it affect the case at all given that although I told them in the LBA that I would be claiming interest if I had to take court action I didn't actually show amounts on the original sheet for interest?

Any advice gratefully received.

Yes

Send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

Dear Sir/Madam

(Your Name) –v- (Bank)
Claim No: ********
Date Issued: xx/xx/xx

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.
Yours sincerely,

Wait until you receive the Notice of Acknowledgement from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

Dear Sir,

(Your Name) -v- (Bank)
Claim No: ********
Date Issued: xx/xx/xx

Please find enclosed a copy of my schedule of charges relating to the above claim.

Yours sincerely,

Thanks very much for the advice. I have posted the copies off to the court. I am just unsure as to why I should wait for the notice of acknowledgement before sending anything to Capital One?

The Notice of Acknowledgement will have the name and address of Cap 1's legal dept/ solicitors on it.

Well you can , but since it will be Cap 1's legal dept/ solicitors who will be dealing with your claim from now on, you might as well wait and send it to them.
