Default Debitas/Capital 1

Hi all

About 2 months ago i set up a payment plan with Debitas (3 months at £30)

I recieved many calls from them asking for more money and the payment plan was not in place because the amount was to small.

I payed 2 months at £30 but didnt send this month because i wanted them to contact me as i had lost the debitas headed letter and forgot the company name so i couldnt contact them. The reason i wanted to contact them was to set up a Standing order.

Recieved the usual arogant phone call yesterday evening at about 8.30pm (the office closes at 7.00pm) asking me to pay the full amount of £1300. I said i cant afford it at the moment i can only afford to pay you £30 untill my circumstances change. They refused my offer and insisted on £50 which i can not afford.

I asked them again if i can set up and standing order of £30 and they refused and told me another company will be in contact soon to get the full amount of £1300.

Can they refuse to accept a payment from me? and if so have you any idea what will happen next.

thanks lee

Well what they will do now is pass the account off to a Debt Collection Agency who will persue you for the debt, this isn't always a bad thing if you were incurring interest as this is usually frozen. They may well refuse your offer but if you were to just start sending them the payment then they are hardly gonna throw it back in your face and if they did take you to court they would look so stupid as you are paying them something. You should only be paying what you can afford and nothing else. Heres what i would do.
  1. Go to National Debtline and download the personal budget sheet and do it as correctly as possible but remember you need to live.
  2. If you have more than 4 debts you could always use a Debt Manager for free you could use Free Debt Management company | Payplan which is what i use and they are really good.
  3. Send the budget off to them indicating how much you intend to send them as payment. This form is what the courts would use if they were to calculate how much you should pay. and if you are interested in signing up to payplan i'd do it and get that all set up.
  4. Make sure you keep in contact with them about it all so if they were to take you to court then it looks good you have been telling them where you are etc.
I wouldn't worry. Im sure it will be ok and you will get yourself out of this problem. Good luck and let me know if you need more help.
