Exclamation Re: Innocent vs Capital One

Just checked MCOL
You are unable to take any further action online on this claim.

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

Haven't received anything yet thru the post????

If your experience is the same as mine expect a letter from them this week stating they have credited your full claim back to your card, if that then leaves a credit balance they will forward a chq within 14 days. Mine came this morning along with their defence from court which stated that they disputed the full amount of the claim but paid it anyway, without admitting any liability obviously !!

Talking Re: Innocent vs Capital One WONNNNNN!!!!!

Letter received today dated 5th Dec from 'Graham Daley, Executive Office':
Write in connection with claim....

Denied that these fees are unlawful... terms and conditions...

"Whilst we do not accept liability for the claim, I have in an effort to resolve this matter without the need for court hearing, refunded £x to your mastercard account and £x to your visa account. This refund has cleared your balances and left your accounts £16.90 in credit. I have arranged to send you a cheque for this amount today and it should arrive within 14 working days."

"These refunds are made purely as a gesture of goodwill and we will now defend this claim on the basis that we have refunded the correct amount."

We may still add fees...

Hope happy with resolution.....

Yours sincerely

I WONNNNNNNNNNN!!!!!

2 CREDIT CARD BALANCES CLEARED AND A XMAS PRESENT OF £16.90

(with exception of 38p daily over 4 weeks.... big deal lol)

(Its my first battle to win and I am so happy)

(Capital 1 is so easy )

Thankyou for all ur help and support here........ really appreciative to know so many others going through same process... and to know their next move before they do

I will donate at relevant time....as soon as i know funds cleared.... which leads me to ask...

*When do I cancel MCOL? When I receive my next statements and the small cheque?

*Should it be sooner, as there is a danger they stilll want to defend the case, as written?

THANKYOU THANKYOU THANKYOU

Innocent

Well done Innocent

Just make sure the money is in your account first before you stop the action. Just a precaution. Great win.
