Question Re: Falconer V Capital One Credit Card

Hi
Recieved a letter yesterday 15th November for a settlement of £200.
I won't except this as charges total £800.
Can anyone tell me how i go about the next step?
They forgot to enclose the letter for my to send back agreeing to offer. So do I write and tell them i will not except there offer and take them to court.
Any help would be great thanks you!
Sally

Hi Sally

If you have tried the tried and tested procedures so far and they have failed to settle, then the next step is Moneyclaim. They will normally pay out when they get served.

Hi
Took capital one to court and they took there time but have decided to settle got a letter about two weeks ago stating that they have refunded the whole amount on my my credit card which is now in credit and they are sending a cheque with balance but to allow 14days for it. So that day is the 26th January so awaiting the post everyday as it then tkaes 5 days to clear and could do with the money. If this doesn't happen i will continue to tkae them to court. so fingers crossed will keep you posted.

Yeah it works in a simular way. You can claim back late payments and over limit charges. It's a different letter which you will find on this site. But and same process. Good Luck!
