Default No dispute say Cap 1!!!!

Hey guys, I sent off for a list of charges which Cap 1 kindly sent and itemised. Very nice and easy.

At that point I owed approx 320 on a £200 limit. However £240 was unlawful charges.

I sent prelim letter and got offered £80. I thanked them for their partial payment and said I would pursue the rest including the 2 new £12 charges added. At the same time they sent a letter mentioning defaults (standard trick I am now noticing...see the MS thread I am about to start!).

I replied statng that I am seeking the rest of the charges and therefore the account is in dispute and therefore they cannot default me.

Got letter today saying SORRY WE ARE NOT IN DISPUTE as we paid £80. Hope you are happy....now please pay up.

Now if I am not wrong...I am disputing the amount owed....therefore we are in dispute....YES?

Going to enter moneyclaim tomorrow and pay the £20 arrears to cover my @rse.

Am I wrong?

Morgan Stanley - defaulted on CCA request - ball is in their court
Birmingham Midshires - starting claim 1st March £3000+
MBNA - Settled in full
Amex - CCJ issued against Amex and full refund taken by Bailiffs - cheque received eventually!
Marbles - Full settlement
Capital One - Received full amount plus costs

yes,the account is disputed(in particular the balance owed) and if they need some help,refer them to the banking code.....

And if they still insist an arsing about,threaten them with a court injunction,the costs of which you will add to the claim!!

Nice one. Up early and spreading mayhem in the banking world today aren't we?

Going to start the Moneyclaim today and write a very stern letter to Cap 1.

Having problems with MS too who sent me a default notice even though they haven't supplied a copy of CCA and I have sent prelim for a refund of charges.

Do any of these people follow the banking code. I think today is going to be a long day of research and drafting letters to people.

Looked through the banking code but could't find the bit about accounts in dispute. Anyone know where it is?

It's ok I got it from another thread. This site is good!

section 13.6 of the banking code states that:

We may give information to credit reference agencies
about the personal debts you owe us if:
• you have fallen behind with your payments;
• the amount owed is not in dispute; and
• you have not made proposals we are satisfied with for repaying your debt, following our formal demand.
