Exclamation Cap 1 not doing repayment plans anymore!!

Just had a very intersting conversation with Capital 1 - rang as I am still over my limit even thoguh been making regular payments for the last 5 months that have in turn been eaten by a £20 over limit and £20 late payment fee.

Asked why this was happening and was told due to them reducing their over limit fee to £12 they are no longer offering repayment plans where they stop the charges onto peoples accounts who make regular payments for 2+ months.

I am sure a judge in court will be horrified to hear this! (btw I asked him to confirm this as I would be posting it on here and he said everyone who had been on a plan had been written to)

Had a good rant about charges and reclaiming them and how people need to go to vcourt to get money back, what a waste of time and money etc...!!

Ahhh lovely way to start the day ;o)

I am currently waiting till I get £50 'spae' to start cout proceddings against them, seeing as I am paying them back £50 a month debating if I should miss the payment next month to make the claim - I know it goes against all the advice to stop making payments, but think a one off to get the charges back and pay the account off might be worth it!! Any thoughts?

I am currently paying off capital one through a payment plan with payplan which i have been doing for the last 18 months and they have stopped all interest and charges. However i would carry on paying them because if it goes to court it looks good in your favour that although they are adding extortionate cost's you are still making your monthly agreed payment. I am also in the process of getting my statements from capital one and claiming back all of my charges.

This applies to people who have only recently entered into a payment arrangement. I believe they had a cut off date sometime around August.

I think this refers to payment plans that were agreed with Cap One and not arranged through outside agencies, as you still pay the interest.

My agreement was cancelled too even though I had kept up to date with payments and paid the correct amounts. So now I have another two months worth of charges, plus the amount I pay barely clears anything of the balance.

I am sure that the law is if you keep to your side of the agreement then they have to keep to theirs? As my agreement which I have in writing states as long as I keep to my side then they will add no further charges on to the account. It did not state any timelines to the agreement, yet when I rang I was told that the agreement had come to end!
