Default Cherry v Capital One

Hi, I sent off my first letter to Capital One 14 September requesting a list of charges, which they did reply within a week, then sent next letter asking for them to refund full amount ( £632.00 on 1st October ) - they replied today (letter dated 5th) offering me £184, reducing each charge to £12, which seems to be a common offer from them looking at other people's posts.

So now I need to write back to them and decline their offer, and inform them I will be going through MCOL to claim the whole sum and give them 7 days to respond before putting in a claim or shall I start the ball rolling through MCOL now ?

Also have requested a refund for my husband's Capital One card for £902, and we are waiting to hear back from a guy at HSBC after they refused to refund us £2393. We have given them 7 days to refund, which ends tomorrow, so i will start the claim through MCOL on Friday...

Let's see what happens !

I think you are best to stick to your timelines, even though they have refused you a full refund.

Most reply accepting the offer as part settlement. I did this and put the letter in with my LBA letter (2nd letter) giving them a further 14 days. You need to show that you have given them a reasonable amount of time to settle the claim.
