Default Proceeding with MCOL ... Little Help?

But just a quick question...

Cap One have done the usual, and offered to refund so that the charges equal £12 a month. My argument is 'I've caught you stealing, so you just hold your hands up, 'Okay, you caught me, have your stuff back, see you later.'' Not really on I reckon. (just so nobody thinks I'm being greedy for the sake of it.)

I'm at the point on MCOL, it wants Cap One's address.. now the address I've been talking to is a PO Box in Nottingham, while their registered office is 350, Euston Rd. London.

Which one? I'm guessing registered office?

keep getting

The mcol thing *seems* to be working for me... right, I'm struggling a bit now, and I'd like some input?

I've basically paraphrased the info I found in the templates section :

I have a contract with the defendant, dated XX/XX/XX, which is conducted on their standard terms and conditions.

I am claiming for the return of money by them, taken in charges over a period of four years plus the interest charged, charges which I now realise are illegal due to being a disproportionate penalty and therefore unenforceable, as they are contrary to common law.

Furthermore, as a disproportionate penalty, they stand as invalid under the Unfair (Contracts) Terms Act 1977 s.4, and under the Unfair Terms In Consumer Contracts Regulations 1999 para.8 and sch.2(1)(e). In the event that the charges are not a penalty, they hare unreasonable within in the meaning of The Supply Of Goods And Services Act 1982 s.15.

Despite communication with the defendant, no reasonable justification or full refund has been offered to me, therefore I am claiming for the full return of the sum taken, including interest at a rate of 8% from date of recorded debit.

Now I thought that'd be alright, outlines the case (as they request), fairly conclusive (open and shut really), but having read Bankfodder's 'sticky', I'm not as confident. Opinions anyone?
