Default Clanger v Capital one \ debitas

After my father put one of Debitas' trained dummy in his place legally - by not making contact with my parents home etc and refusing to divulge my whereabouts and telephone number (I'm in the RN) ...... SECTION 40 OF THE ADMINISTRATION OF JUSTICE ACT ; “S40 Punishment for unlawful harassment of debtors.

Debitas now are making contact with me on my mobile phone (now where did they obtained the number from?)
As it is unlawful to contact at place of work, last eveniing Friday 25/08/06 Ihad three telephone calls within 10 minutes from Debitas (name with-held) and the debitas Dummy stating that he's working 'till 9pm and he will continue to phone non-stop. I accused him of harrassment and the calls stopped. Today they are at it again!

Dear Sirs
I am writing to express my serious concerns regarding both the quantity and frequency of telephone calls that I have received from your company.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I am now formally requesting that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am now familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.
If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.
You will be deemed to have been served notice of my request no later than 2 working days after postage and I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence. (Even if you don‘t yet have recording equipment!!)

Hello
I had been paying Capital One £5 a month since September 2007 and sent them a budget sheet showing my expenditure and my income with an explaination of my circumstances, and that I would contact them again when my circumstances improved.

February 2008 I received a letter from Debitas asking for full payment. I replied by letter reiterating my circumstances and that I could only afford to pay the £5 a month, which I have already been paying to Capital One and would continue doing so until my circumstances change.


I have since received two letters from Debitas on the same day one thanking me for my letter and my payment of £5 a month, which they said was not sufficient. The second letter stating that I had not responded and that they would send an agent in seven days to discuss my debt if I not get in touch with them to arrange a higher payment. I replied by letter reiterating all that was in my last letter.

I am concerned about someone knocking on my door, and can anyone give me advice what to do next.

Don't be. First, that's extremely unlikely and second, knocking on your door is all they can do. You can tell them to bu**er off and put anything they've got to say in writing.

Unhappy Re: Clanger v Capital one \ debitas

Hi I have and am having dealings with this unhelpful company!!! I went on a debt management pro gramme and paid capital 1 £50 pcm then they sent my account too Debitas... I can receive up to 9 calls per day. we offered to pay the full amount on my husbands card which they agreed and told me to call back tomorrow when the card machine was working---we did only to be told they would not now accept this card so I needed to pay upfront all of it--when i told them I could not they said send a cheque- I explained again I am on a debt management scheme so have no debit card or cheque book, there reply was for me to do overtime!!!!!! I informed them i was not allowed due to my health and I questioned who they were telling me too do overtime they have now threatened me with court action if I do not pay in the next couple of days!!!!! what do I do if I was already paying cap 1 £50 per month as agreed I am not able to pay anymore than that!!?? so unhelpful and so not understanding me when I speak ( I am a UK citizen)
