Received a letter from NCO Debt Collection Agency, usual stuff.
Have written back standard letter saying account is in dispute etc

Letter received today from Robert Udy, Executive Office Manager. Basically its all about they're information on my credit reference file, the t & c's etc and how they are within their rights to disclose the information. Nothing said about the information I have requested in the Data Protection Act - Subject Access Request.
Written back today Non-compliance template letter no. 1. They have 10 days left to comply.

Received letter re claim offering me a full and final settlement of £120 and to go away. Now my problem is this: I owe them £441, my claim is for £313, they have offered £120. At the same time NCO have 'bought' this debt and I have sent them a CCA 1974. Shall I say thanks you to cap one for the money, and continue against NCO (hopefully to get the debt cancelled), therefore making me in profit for £120. If I have made myself clear.
Anyone got any ideas on this pls.

In the first instance, establish whether NCO have actually purchased the debt or are merely collecting on behalf of Capital One.

Secondly, do not settle for £120 if the charges are £313. Carry on with your claim.

Ok have written back rejection of offer, and have received another offer back, which comes to 90% of the total claimed. Due to financial situation and xmas coming I have decided to accept the offer, and have signed and returned the acceptance slip, although I shan't be getting a cheque at least the total owed will be reduced and that is a good thing to happen anyway.
Thanks all for your support. Another one for the filing cabinet.
