Default Cap 1 debt passed to Bryan Carter help needed

Hi there

I've posted this question in another forum not sure if this is the right one or not

I have a debt with Capital One for £1500 pounds, its now in the hands of Bryan Carter Solicitors. I am sending off my Data Protection Act subject Access Form tomorrow. However who do I claim from? If the debt has been sold are Capital One gonna pay me, thing is If I claimed back all my charges it would reduce the debt to less that £750 pounds, I could then make an offer of £375 and finally lay this ghost to rest. I'm going to pay them a £10 gesture next week so they can keep it on hold for another week or two. DPA letter to be sent tomorrow anyway.

Really would apreaciate help on this one, really.

Im no expert but I would think that captal one set charges against you therefore you should claim them back from capital one

Hi,
Be warned that Bryan Carter will CCJ you for £125. This they do under C1's name but it's actually for their fees.
You have a defence if they do. Either come here or you can PM me if they do.

Send Cap 1 a CCA s78 demand with a faxed (if possible) copy & covering letter to Bryan Carter

The moment Cap 1 receive your CCA s78 demand they are in default until they supply you with the info. This means that no one can pursue you for payment until Cap 1 have complied.

When you post your letters faxed or not make sure you use "Special Delivery" that way you can "trace & track" your letters

Its called turning the tables

oh, I alraedy sent a Data Protection Act subject access form to capital one today, prob best I leave it a few days and then send the CCA s78, I shall send the CCA s78 byy special delivery - but the DPA subject access from was sent by recorded delivery.

They wont be told for a while that you have made a Subject Access Request.

Send a CCA s78 to Bryan Carter now. It will stop them pestering you

PS Always use "special delivery" Then you can "trace & track" Its great knowing when your bombshell lands
