cap1 phone call issues

Hi, from looking through the previous posts and threads i am a little unsure as to exactly what stance i have, the issue:

capital one contact us on a daily basis, at this point in time the mortgage is more important. capital one were told this and have been told this everyday, i have told them i will make payments when they are available.

the issue lies with them contacting me everyday. from reading the posts i have found that you can request for them to contact only in writing, i am unsure as to how to approach this request.

should i write to them? to which address?
what legal stance do i have?

if the phone calls continue after the request it is considered harassment, is this true?

i want all the facts so i can argue my case with confidence

I am writing in regard to the quantity and frequency of telephone calls that I am receiving from your representatives, which I find to be personally harassing.

I have previously requested that these calls stop, but I am still receiving them.

I now require all further correspondence from your company to be made in writing only.

I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
