Capital One penalty charge repayment policy We have received information that Capital One have admitted that they are expecting the OFT to tell them what they can or not charge before the end of march. Apparently until they are told the amount they are allowed to charge they will be paying out every claim.
After the OFT provide them with an acceptable figure, they will contest any claim which exceeds that OFT approved amount.
The view of The Bank Acton Group is that if the OFT recommended amount exceeds the costs suffered as result of the customer's breach of contract that it would still be unlawful and that claims should still be made.
