Default Capital one n1 claim help

I was wondering if someone could help me. I'm in the process of sorting out my N1 and have a few queries before i send it.

Associated Overdraft Interest charge
Is that contractual interest? and is it too late to add it at the court stage

Can you ask for Court Fees if you'r applying for a Fee Remittence?

For the Plus Interest Pursuant s.69 County Courts Act 1984. If you put "rates and periods as the Court deems just" will i only get the amount i've claimed for upto todays date if/when Capital One settle before Court as if it's too late to claim Contractual Interest i won't be able to work it out on a daily basis

And the last one will probably sound like a stupid question but on the Statement Of Truth do i just need to cross out the parts i don't need or do i have to remove it off the form

Thanks

Hi AL

Some people call the associated overdraft interest charge 'contracual interes' but I find that confusing. What it is is the interest that youhave been charged on the charges - the advanced spreadsheet works it out for you.

You don;t claim court fees anyway, they get added to the claim automatically. If you get fee remittance, let the court sort that out.

I wouldn't put that, I would put "interest at 8% per annum of £xx pursuant to s69 of the Countty Courts Act 1984 plus interest at a daily rate of 0.022% to the date of judgement or earlier payment"

Just cross out the bits that don't apply

Hi Steven,

I can't seem to open any of the Contractual Interest spreadsheets, to work it out. I'm desperate to sort out my Welcome Finance one as it's nearly 60% interest but they wont open.
How do i know what interest has been charged?
On the value part on the N1 it's got Court Fees do i just take it off

Court fees go in a seperate box - the court fills that in.

What happens when you try to open the spreadsheet? Do you get an error message?

On the Complex Credit Card Spreadsheet, What do you put on the Schedule of claim for charges. And on the spreadsheet it asks for details for your sort code do you just delete that off the spreadsheet

Do you mean the sort of charge? If so, jsust what it says on your statement. Alter the SS as appropriate ie ignore things like sort code if they do not apply.

It doesn't matter too much - bank name, put Capitol One Bank (Europe) Ltd, account number, put your creedit card number, leave sort code or remove it.

Hi, Steven

two more things where the £xx is, do you put the total amount of charges or something else and also for the interest part i hadn't put that in my claim is it too late to add it to my N1

Thanks

You put the interst at 8% so far (ie from the date of the charge to the date of the claim) for each charge and added up. If you have not yet submitted an N1 then, yes, you can add it in.
