| Re: jellybabe v Capital One After sending them a reminder about my Data Protection Act request,i finally received my statements this morning.
Hightlighted all my charges already,and found that they charged me £458!!
And that is without the interest.
Preparing my request for repayment letter right now! |

Prelim sent.........received the usual bog off letter.
lba sent on the 17th august.
Had another charge on it.
Deadline to respond to my lba is the 31st August.
MCOL due on the 1st Sept.
Let's see what happens until then. |

Not sure what to do now, as i filed my claim already??
When they ring up to settle, do i just let them add it onto the claimed money?? |

| Re: jellybabe v Capital One Received letter today regarding my claim.No liability, Blah Blah Blah, will still be adding charges in the future, blah blah blah, but out of goodwill, offered me the full claim amount back.just waiting for the credit to appear on my statement before i let the courts know.
Another one bites the Dust!!  |

congrats on yet another win. I have just sent off my prelim to Cap1 and had a meesly offer which I will only accept as a part payment but could I ask you what interest you added to your charges figure as I keep reading threads about contractual interest etc & really don't understand spreadsheets(or computers for that matter).Did you get the MCOL fee back as well? and where do you actually claim that on the form in the figure with the charges?

Cap1 sent me the same offer of £150 three times. And all of them i accepted as part payments, but none of them actually got refunded to me.I did my claim with the normal statutory interest only on this one, as i wasn't at that time sure enough how to do it with contractual interest. Could bite myself now, as it would have increased my claim by a couple hundred pounds.
You do get the MCOL fee back, when they pay out.All you have to fill out are the particulars of claim, and then i think at the bottom, amount claimed.....your amount +the 8% statutory interest.Then the court fee.....can't remember if that is filled out automatically, you'll have to have a look. If not enter the amount there.You won't have solicitors costs...leave that empty, and then just the total amount you are actually claiming at claim date (ie.charges, interest and court fee total).
But, if you want to go for contractual rate...you can't do that on MCOL, you'll have to fill out a paper claim form and send it to the court. Because the particulars of your claim would exceed the limit of words you can enter online.

not sure if you're still around but am only just about to fill in my MCOL as had a few mental weeks on the homefront  so I was wondering if you used the same template for your credit card POC as the one for bank accounts as I can't seem to find anything else
