Hello

Have you claimed back any of your charges yet?.. First thing to do is check to see if you have an unenforcable agreement. Capital One had been sending out application forms, and saying that they are Credit Agreements for years. It would be worth checking that first.

There is a link here to give you some guidance:

http://www.consumeractiongroup.co.uk...agreement.html

Also you shpuld get an S.A.R (Subject Access Request) from them as well. This will cost £10, so put in a postal order to cover their costs. This is for all of the data they have on you, statements, letters, default notices etc.

There is a link here for you to read up on before sending your letter:

1. Data Protection Act, Subject Access Request letter - List of charges

Data Protection Act - Subject Access Request Generator *** New ***

The first link is for guidance and writing your letter. The second link is for the automated letter creator.

There you go Davrig, told you you'd get more advice if you started your own thread. Frederickson are gits but they'll probably zap your account straight back to Crap One once you send 'em an Subject Access Request. Once it gets back to Capital One it will be easier, they tend to pay up charges quite easily, defaults are a bit harder but can be done. If you need any help just ask, someone will be around.
