Have you claimed back any of your charges yet?.. First thing to do is check to see if you have an unenforcable agreement. Capital One had been sending out application forms, and saying that they are Credit Agreements for years. It would be worth checking that first.

Also you shpuld get an S.A.R (Subject Access Request) from them as well. This will cost £10, so put in a postal order to cover their costs. This is for all of the data they have on you, statements, letters, default notices etc.
