Red face Before i jump feet first???

Hi all,
Just a quick question before i jump feet first..I had to pay back over £600(over drawn and non payment) charges just to get my capital one card down to its credit limit so i can now use my card i even went onto a payment plan to clear the card paid that off in 1 month insted of 3 months and they said i still have to pay back the full 3 months payment plan charges because i paid it off early!..i would like some of this money back cant think why ..but if i clam these charges back are c*ap one going to close my account? or are they not allowed to do that?

Hi gazzauk80, welcome to the site.

It is certainly a posibility which is why this site would generally advise you to open a 'parachute' account in advance of taking any action. It is becoming an increasingly common option for banks to pay out and then to state that they feel 'the relationship between the bank and the customer has broken down' and they have no option but to close the account.

A number of people are exploring whether this is a legitimate action and whether they can be stopped but my guess is that for the moment you should at least be prepared for the posibility.

Look on the bright side though if (when ) you get the charges back you will be able to repay a chunk off the outstanding amount anyway.

Read the faqs and follow the process and post back with any other questions - there are lots of very helpful and knowledgable people about who will pitch in.

no thats the thing i have already paid it all back..and are able to use my capital one card now..but it all started i jan 06 when we moved didnt really have the spare cash to pay it for a month so they put a late payment on my account which took it over drawn then added over drawn charges and so on and for a while i put my head in the sand and thought it would go away..But then got a letter from them saying that i could keep the account if i go onto a payment plan so i took up there offer paid it all off in a month but then they charged all the intrest and charges for 3 months since i paid it off quicker...agghhhh cant win with them thought they would be happy to have my account in credit again..since the account it running fine i dont really want to lose it just want some of my money back

Hi there, if you make a claim, there is always a risk that they may close the account. But if you don't make a claim they will certainly not volunteer to pay you any of the money you are owed.

If you have good record now and have paid back the debt then why not apply for another card just in case, then get your money back.

Surely there must be a precedent somewhere stating that if they close down the account for this reason that its affecting your consumer rights. If you made an industrial injury claim at work and they sacked you, you would immediately have them in court! Anyone else agree or am i talking cr** again lol
