I hope this is just friday afternoon tiredness kicking in, but I have a feeling we are being quietly stiched up in the corridors of power....  |

I am sure you will know that I give this a lot of thought too as do other mebers of the forum.
Its difficult to read whats going on but please believe me when I tell you that every effort is being made to provide the Information Commissioners Office with information to support our view and hopefully give the right decision.

| Re: Information Commissioners Office Not sure if this is a sign of the outcome or anything but I received a full set of microfiche statements from Abbey this morning about three weeks after complaining to the information commissioners office and 5 days after I got a reply from them.
At least I don't have pay a court fee for data protection non compliance (which I should have done at the same time as my complaint to the Information Commissioners Office but I was waiting for their verdict on Abbey). |

the info comm is investigating whether the banks are allowed to do this (not give details of charges because of microfiche argument) It will make a decision this week, A spokesman for Abbey says; `We had an informal discussion with the info commissioner earlier this year and were told that our filing system did not come under the Data Protection Act. Now it appeas it may have changed it's mind' |

| Re: Information Commissioners Office Well its time once again to thank those who provided information for the CAG to send to the Information Commissioners Office.
I was very sceptical about how the information would be used if at all. Since this thread started the CAG has been developing a relationship with the Information Commissioners Office and in particular the people responsible for dealing with the Abbey investigation.
I cannot be absolutely certain, but I have been told that the information that has been provided by forum members, either directly or indirectly was very useful to the Information Commissioners Office.
They will be visiting Barclaycard shortly, the 19th as I recall. I cannot be sure of the outcome but I can guess.
I suspect that now there will be some specimen cases by both Abbey and Barclaycard to see if the courts agree with the Information Commissioners Office.
Ultimately this isn't the end, its not the beginning of the end, it is however, the end of the beginning. Didn't someone famous say something like that once!!!
Lets hope the opposition face the same fate now as the opposition did when those words were originally spoken.

| Re: Information Commissioners Office I cannot be certain but the rumnour i heard was that it was likely that the same letter that will be sent to Abbey would probably be sent to Barclaycard.
I understand that the Information Commissioners Office is likley to issue new guidance in light of the change in position with respect to the fiche systems.
IUncidentally it is nt a fiche issue solely as I understand but is wider than that.
