I started a moneyclaim case, they acknowledged and said they intended to defend. I received an offer from the solicitor for 50% which I rejected and then they offered me the full amount. No allocation questionnaires or anything.

Received a letter from DLA Piper Rudnick Gray Cary. This is what it says.

Dear Madam

Yourself -V- Abbey National PLC (sued as "Cahoot")
Northampton County Court - Claim No: 6QZ457993

We act for Abbey National plc in this matter. Please note that any further correspondence should be addressed to us at this office.

We are in the process of reviewing this claim and preparing the Bank's response. A defence will be filed in due course.

In the meantime, we note that you have claimed the sum of £1531.49 in respect of charges that you say have been made on your Abbey account, but have provided no details as to how this sum has been calculated. We also note that you have claimed and additional £272.67 in interest but again have provided little detail as to how this figure has been calculated.

As you will appreciate, you will need to produce evidence to the Court of both these amounts. This information should have been supplied by you when you filed your claim. We should be grateful if you would provide such details to us as soon as possible.

We should add that if you have any doubts or corncers regarding your legal position you should consult a solicitor or Citizens Advice Bureau.

Yours faithfully

The letter is unsigned although there is an email address of someone called Paul.

Had time to think about letter and look and see if anyone else had received it. I suppose this means they will contact Moneyclaim on Monday and tell them they want to defend.

Sent this just now via email.

Dear Sir

Thank you for your letter dated 28th July 2006.

I am surprised you have no details regarding how my claim has been calculated. I have already sent Cahoot two copies of my spreadsheet in my previous communications. However, I attach to my email a copy of my excel workbook. I will also put a hard copy in the post first thing Monday morning in case you experience difficulties in opening my spreadsheets. Cahoot under the Data Protection Act supplied the details of the charges applied to my account to me. If you would like a copy of these details I will be happy to supply them to you, however they will take a while to get to you as I do not have a photocopier at home (perhaps you could ask Cahoot for them?). The figure of £272.67 is claimed under section 69 of the County Courts Act 1984 at the rate of 8% a year from 4/4/2002 to 11/7/06.

I look forward to seeing a copy of Cahoot’s defence and would be grateful if you could supply this to me as soon as possible. I am sure that you will also have the necessary information with you as to the actual costs incurred by Cahoot in respect of dealing with transactions, etc. I would be grateful if you could forward a copy of this information to me at your earliest convenience, therefore allowing me time to analyse the information you wish to present and to assist me further in preparing my defence prior to the court hearing.

Good Luck... I have checked that address.. and it is the address they said on their website.. surely they cannot contest this? I am able to put out a warrant but don't quite know what to do... Shall I sent them a letter?

If it was me in this situation I would go ahead and issue the warrant. They should be capable of sending letters on the right office. If there is a problem, let them sort it out at thier end.

This is just what I would do and you must do what you want.

I can totally understand that, why not an email to them along the lines of;

I have recently won a judgement by default against Cahoot (claim number). If I do not hear from you by 10:00 tomorrow (1st August 2006) I will instruct the baliffs to recover my money.

At least then you would know you have given them plenty of warning.

Best thing is just to send them your schedule of charges (the 8% jobby)

Put a covering note with it - how suprised you are that the bank havent provided them with this information, and if you can email PAUL with it, and copy the letter in the post.

Been on holiday and got back yesterday to a letter from DLA Piper (the more expensive kind according to the new rules). It is an offer for 50% of what I am claiming. I will be writing back and rejecting thier very kind offer. Also attached was a copy of thier defence.

I also received an allocation questionnaire from the court which is not as scary as it sounds. I have until the 30th August to return that. Prehaps if cahoot is a decent kind of bank they will pay me before I have to send it off.
