Smile Ant VS Cahoot - Some Help Please!

Hi there,

I am a new poster and have been monitoring the site closely throughout my claim process over the last few months. I am currently at the stage of filling in the online MoneyClaim form because I have not received a response to my last letter.

I am a little confused as to which address I need to claim for from Cahoot though. Is it the branch where my account is held? (Cahoot, Friars House, Coventry, CV1 2ZA). Or is it the address that sent my the first reply saying they would not pay? (Abbey, Banking Specialist Team, PO Box 5885, Milton Keynes, MK10 1FA).

Any advice would be very gratefully received.

Also, I have just received a letter from Abbey saying sorry for the delay but the need another 4 weeks - do I take them to court now or wait for another 4 weeks? Thanks

use the branch address. Ignore the letter it is stalling tactics continue with the next phase and instigate court proceedings.

Hi again guys.

Just a quick question - I sent my court claim in last week and a day later (obviously coincidentally) I received a letter from Cahoot offering me a crappy £90! I have claimed £950 in total from Cahoot and will not be happy with any less - do I need to do anything differeently now or can I just proceed with the court claim? I think they are going to pay me the £90 directly into my account - should I just leave it there?

Hi again folks,

I just received a letter from Abbey - they say that, since I filed my claim, they have become involved in legal proceedings with the Office of Fair Trading (OFT) and that they are asking the County Court to 'stay' all claims relating to unauthorised overdraft bank charges. This means that, if the court agrees, my claim will be put on hold until the outcome of their court case with the OFT.

They say in conclusion that, as soon as the court case with the OFT is over, they will address the matter of my claim asap.

Do I just have to wait??

Ignore Abbey and follow the instructions from the court. Abbey will need to apply to the court for a stay - check out if your court is issuing blanket stays or dealing on a case by case basis - there is a thread on here but can't find the link.....
