Wow, after all you did to let them know there was a court case. I would wait and see what the paperwork is before you ask them to change court, after all it could just be for a set aside hearing.

I have not had one myself but I have read about them in other peoples Abbey Threads. It would appear it is where Abbey have a judgement against them by default (like you) and when they have to pay up they apply to the judge for a set a side hearing saying they did not receive any of the paper work from the court. The court would appear to always judge in Abbeys favour and then the court process starts all over again. It is just a stalling tactic.

Right...
Rang the courts yesterday as I got off work a bit early. Spoke to a helpful chap who said that the notes said it had been passed to his department - but he hasn't recieved it as he has processed that batch. He's going to do some digging for me and get back to me today. He couldn't tell me what the application was for? so I will find out later today hoepfully!

Sorry I've not been around for a while guys.. new business has been going great, so this had to go on the back burner...

Update:
Judgement was stayed for 14 days giving Cahoot a chance to make an application
Just phoned up now, and they ahven't made an application... BLoke at the courts couldn't understand why they had doen that (delaying tactic on cahoots part I think)
SO I ahve e-mailed them givving them till 3pm to ring me, before I take out yet another warrant.
However - I will ring them at 3pm if I haven't heard anything. And try and speak to someone..

DO I just phone customer services, or another number? I have had nopthing from their legal team or anything..

Spoke to Abbey legal team... well spoke to someone at cahoot who relayed the info, then got a very panicy phone call from there legal team. They are applying for judgement to be set aside - though the judge might well tell them to P*** off as they missed their 14 day window. they asked me to hold off taking out another warrant until they make the application - so I will give them a couple of week (I am moving soon - so I won't be able to chase them up anyway).. I will rinf them a week friday if I haven't heard anything. Would be lovely to get the money before christmas though I'm not holding my breath...

RIghty ho... Sorry for the long wait... I have moved house and it's all been very busy.. determined to get back on track with my claims now though...

I phoned abbey last week and they said.. sorry, sorry, sorry... Soemone will be in touch tomorrow.. NO sign of it.. so I will phone them later and have a go... It shoudl be a case of them simply paying up now...

Chimera why are you letting Cahoot mess you about. If the shoe was on the other foot you would be faced with hefty charges and possibly a CCJ. Send the Baliffs in and get your money. You have done everything by the book, you have given them more than enough time to pay up. Just my thoughts after reading this I'm not an expert. Looks like I will have to think along the same lines as you. My case goes to court in ten days!!!!!!!

HI Guys.. due to unforseen circumstances I ahven't done much to follow this up.. but I'm onto it now... just spoke to courts and they have not applied to ahve judgement set aside... Have tried contacting abbey to basically say pay up or else.. but no response... could anyone please PM me with ANY numbers you ahve for the abbey legal team..

ANd post any suggestions of what to say to them. I will ahve to apply for another warrent, but someone has suggested I get professional baliffs in rather than the court baliffs.. suggestions please asp.. I ahve today to sort this out.. then I'm in work and can't phone...
