It really shouldn't matter.. I mean.. they are a big company - it shouldn't take them 14 days to read mail and pass it to the appropriate person. Will be interesting though, as we used differnt addresses. If they give the same excuse to both of us, then we have them, good and proper... and the courts won't look kindly on that...

Just realised: I ddin't use that addrss. I put it in the MCOL form and did look up, which came up with this address - just used this one, as I thought it best to use the one the court has on record. Just so they didn't say it got lost or used wrong address. NOw I'm worried I should ahve sent it to the other address - regardless of what MCOL said. THere were 3, 2 x Abbey National PLC - one PO box Friasrs HOuse, and one at the below addess - and one for Cahoot at the below address. I can only assume, that the below address is the one the PO box address stuff gets sent to. Do you think they will make an issue of it?

Just copied this off their website - so it definately is there address.. could they argue that it is not the PO Box address? They are a big company - I'm sure it shouldn't matter - it is the same address - just written differently... hmmm... I don't know what to do... how long do I give them befor issuing a warrant???

Still nothing yet.. no e-mail.. no letter.. no cash in bank.. Keep on checking my bank balance when I get home from work, just to be sure they haven't debited my account.. but no.. still nothing... THey have until Monday... nervous now... lol

perhaps they do... worried about that.. if I have done something wrong and I send the baliffs in.. and they refuse to pay on a technicality.. probably me getting paranoid.. but I just want my money... got a lovely letter off them today saying that I was overlimit and if I didn't pay it immediately I may incur more charges.... well.. I have about £150 worth to claim back once I have got this lot of money off them... so add it on cahoot.. keep em coming...

Personally I think that they are one of 2 things - So incompetent that they dont realise whats going on or so arrogent that they dont think you will take action!
Im sure if there was a technicality then they would have gone to court with it, from the moment the baliffs get involved they have to pay more fees and charges to the court dont they?

Do you know how you would get your money once the baliffs have gone in? Do they sieze property from cahoot or ask them for payment?

Just a little owrried if they can reverse the judgement by default or something... I know nothing of the legalities... but don't want to pay out another £120 to send baliffs in if I am not sure I will get it back...

Hi,

They would have gone for a setaside judgement if they wanted to defend the action. If the baliffs are unable to get the money for any reason the cost is still passed on to the defendant.

If the worse came to the worse and you send the baliffs in on Monday and Cahoot won't pay and say it is a technicality and get the judgement overturned and all the rest. You will get a settlement from them in the end and you could not accept that settlement until they pay the baliff fees as well.

I hope this makes sense.
