Well we are back to cahoot the credit card that cannot make its mind up what I owe.

Cahoot say I owe £zzzz

They have then instructed a series of dcas. They have told

Apex I owe £aaaa

Buchanan Clark & Wells £bbbb

and the latest being

Moorcroft Debt Recovery Ltd £cccc.

I have now recieved a letter from Moorcroft telling me that they intend to take legal action to recover the debt.

Cahoot recieved the letter asking for the Credit Agreement in August but it was BCW who sent the copy of the credit agreement. 2 1/2 months later.

Am I right in thinking that because the CA was not produced within the 12 working days and then the following 30 days it will now take a court order to reinstate this date.

I should think I will need to tell Cahoot and Moorcroft this. Anyone know of a good template letter anywhere.

They still have not sent a copy of the original default notice.

Do I need to say anything about the variation in the amounts I am supposed to owe.

This is the letter I am sending to Cahoot do I need to add anything to it or is there any terminology/laws I should be quoting?

On XXth Month Year a letter asking for a copy of the Credit Agreement was recieved by Cahoot. As you will be aware The Consumer Credit Act allows 12 working days for this request to be carried out before the company enters into a default situation. The request was still not satisfied after a further 30 calendar days. These time limits expired on 4 September 2006 and 4 October 2006 respectively.
As it was some 2.5 months after the request was made before the credit agreement was sent Cahoot have committed an offence. Cahoot will need to go to seek permission from a judge to enforce the agreement - in so doing admitting to the offence.

Please note this account is in dispute.

I also send a copy of a previous debt collection agency outstanding amount together with a copy of Cahoots own list of Transactions on this account that shows the "overdue debt" amount you have is wrong and as such do not recognise the amount of the debt to your company and therefore require you to supply the following documentation before I will correspond further.

I require that you supply signed true copies of the deeds of assignment of the above referenced agreements..

Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested. I am now in dispute with Cahoot. I will be in contact with you again in due course. In the meantime please be aware that I consider this matter to be "in dispute".

The other dcas letter together with Cahoots own list of transactions make the debt some £2000 less than Moorcroft have.
