Hi,

I may have to start a couple of threads on here, if any one could possibly help with there own experiences or knowledge, it would be much appreciated. I am using this site as I am the only one in my family which is so called computer literate, they all know about this site and wish me to ask questions on their behalf. What I would like to add is they donate funds also and we are in financial trouble as a family through family businesses gone wrong.

My father has received this:

His request for a copy of the CCA made on the 7th Oct 08 has not been complied with. He has wrote to Cahoot after receiving this DN, saying that they are not allowed to send a DN while they are in default of his consumer rights. They have replied through their in house debt management and recovery services by sending him a default of payment notice, which is not sent under section 87 of the Consumer Credit Act 1974.

Basically, he wants to know what his next step is to finding out if his agreement is unenforceble. He roughly took out the loan in 2004 - 2005 the interest rate was 6.9% and now he is unsure of the updated interest rate, however it is considerably higher. They have never sent recent details of the new interest rate changes, he cannot afford to pay it now and we need help to fight back and we know this is the place to be as we have alredy received lots of help on here.
