| | Classic Account Customer | Re: Deb4TLJ vs Cahoot Received one sheet of paperwork from Cahoot in the lunchtime post today with just a record of payments made and dates. Emailed the customer services office with this; LETTER BEFORE ACTION Section 7 – Data Protection Act 1998 Dear Sir/Madam ************************* *** Account No; *************** Personal Loan; November 2005 Address; *********************** You have failed to comply with my Data Protection Act Subject Access Request dated 12th June 2008 which was signed for on the 20th June, proof of which I have from the Royal Mail website. If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice. Yours faithfully Deb4TLJ
Just received this; Dear Deb4TLJ, Thank you for contacting cahoot in Coventry. Having checked your account it shows that the subject access report had been requested on your account. I have requested this again for you and I apologise for any inconvenience caused. I hope that I have fully answered your query and you are satisfied with my response. If you require any further assistance please do not hesitate to contact us again. Kind Regards, Claire Moore So have just emailed this; Thank you for your prompt response. I did indeed receive a single sheet from your company headed "statement" showing all payments and dates payments made on this account. As you are aware, a S.A.R - (Subject Access Request) request requires you to send me; -Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same INCLUDING Loans, payment protection insurance and other products.
- A complete list of all transactions or statements relating to ALL of my Loan Accountswith your organization INCLUDING Loans, payment protection insurance and other products.
-Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information INCLUDING Loans, payment protection insurance and other products
-Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.
- Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.
-Full hard copy print outs of my personal or financial information INCLUDING Loans, payment protection insurance and other products, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations. I do not accept a one sheet statement of payments is a true and complete reflection of my Subject Access Request and, as such, still consider my Subject Access Request unfulfilled. I emailed your office earlier today with an LBA for non compliance - that LBA still applies. I trust you will deal with this matter with all due haste and urgency. Sincerely Deb4TLJ Who do these people think they are?
