People, as you are all so kind, and have been there, i hope you dont mind if i ask a couple of questions.......
I have submitted a claim to Barclays for the last 6 years for Approx £1,200. with 8%.......
What i want to do soon is go for broke ( several £££thou ) 1990 to 2001 with CI.....Firstly is CI feasible/realistic as a sole trader, and secondly, do i need copies of T&Cs for the whole period so i can indentify the interest rate that i need to charge....Many thanks for any info....

I have not got a copy of me T&Cs for the Cooperative Business Bank but I know they charged me 2.5% monthly 34.49% APR unauthorised borrowing rate so yes Im giving it a shot with CI, Celicaman pointed something out that I had forgotten about and that was what the interst rate was in the early 90s, way above what it is now, mind you while reading around oher threads ive never come across another claimant who was charged the same rate as me "I was robbed", ..have you got evidence of your charges as far back as then?..GC

Account control fees, sounds like blanket screen for a penalty charge,
I was charged management time fees by the Cooperative Bank and have included them in my claim..GC

They've ticked the box for Multi track !!

So looks like the guys in red robes and white wigs for me........

Because they have ticked Multitrack does that mean that your court will abide by it! what track did you request! and if it is Multitrack does that mean they will have to make full disclosure!

It means just that they have requested Multi track.
I requested SCT.
We shall see what the court decides, whether they order disclosure, etc

The courts do have the power to order disclosure regardless of track, and also the power if they order Multi track to order a no costs rule.

We shall wait and see what happens.

Hi All

I hope someone can give me some advice please. I ahve already succesfully got back charges from A+L (£1200)without any real bother.

My problem is my business bank account with Bank Of Ireland has been charged over £8k in charges (bounced chqs and DDs). The bank as closed the account however me and my business partners guarenteed an overdraft of £10k with guarentees of £20k each. The bank closed the account when £16k overdrawn. They have started legal proceedings (very quickly) against us for the repayment as guarentors. They have not come to the business that is still running with a new bank account elsewhere. We issued the letter asking for charges back they have since issued court papers for ourselves to the value of £20k plus interest. They have now offered us £500 for full settlement of charges. (yeah right). What do we do do we issue a claim, or do we have to counterclaim to the claim from them saying we admit some of the charge, less the charges we believe to be unlawful.

Any help would be really appreciated

Over the years this has happened twice to me. NatWest the first time and HSBC the second time. Call me stupid for giving the guarantee but, if you have faith in your business then it should not be a problem.

I guess if they try to take you to court then , you would admit 8K and argue the charges 8K. Mine was dealt with from Telford with NatWest, a real bunch of hand picked idiots, I re mortgaged and paid them PDQ as they were adding interest on a daily basis.

Bottom line is your nuts are in a vice and they know it. Have you tried doing a deal with them such as, We believe you owe us 8K on unlawful charges ( not quoting consumer law) and we owe you 8K etc which, your prepared to repay by way of a loan over x years, that is unless you have the 8K spare and do not want them calling on the guarantees.

I do wonder why your guarantees are 40K?

i was in a similar situation i did a cca request to hsbc to gain a copy of the guarentee MADE IN 2002 ,they came back and discharged OUR LIABILITIES of the debt .

Get prove of the guarentee before requesting the charges as im not going after the charges NOW AS THEY HAVE WRITTEN OFF THE OVERDRAFT
