Hi and welcome  Celicaman has given some excellent advice, just one more thing though, Scottish law does have some subtle but very important differences, so when you start your thread either put it in the Scottish section (less exposure there though) or put 'SCOTTISH CLAIM' in your thread title, either way you'll get advice relevant to the Scottish system.
There are links to a couple of relevant threads in my signature, very interesting reading (you might have to do some rummaging for earlier posts if it's not below). Most folk are here to help each other as well as themselves so if you're stuck just ask!

Can anyone give me any advice ? | Hi Largo I recieved exactlty the same type of letter from the BOS but went ahead and issued my claim, The bank put in their aknowledgement of service intendind to defend the whole claim, then called me up and asked how i wanted them to repay me. I recieved a letter from them stating that they were not admitting liability but that for financial reasons they were refunding the charges with interest so plough ahead and go for it..GC |

Have you actually read this thread ?
If you had you would not be asking those questions !!!
Do not start your claim until you actually understand what is involved and you know what you are doing................ taking shortcuts can be costly !
There are a lot of subscibers to this thread who could answer your questions but it will do you a lot of good to start at the beginning of this thread and read it through.
You will also need to start your own thread, and read the sites general step by steps; First of all read the Frequently asked questions here http://www.consumeractiongroup.c o.uk/forum/faqs-please-read-these/ DO READ THE STEP BY STEP INSTRUCTIONS !!!!!!

You’ll then need to start your own thread;
Go to here: http://www.consumeractiongroup.c o.uk/forum/
Find the name of the Bank your action will be against.
Click on it (the name of the Bank in Bold Blue)
On that page, you will then find a label saying "Forum Tools" (just under the list of page numbers).
Click on it. It will show you some options.
Firstly, it's a good idea to subscribe to the Forum ,as you'll then recieve updates from people in similar situatioins against the same Bank. So click on Subscribe. It will ask how often you want updates (Personally I like Daily).
Once Subscibed to the Forum it will redirect you back.
Hit the same button and choose "Start new thread"
Give your Thread a title eg: yourforumname v whatever bank
(choose how often you want updating by email if anyone posts responses in your thread)
Then your up and running !
Whilst your there, you might want to take some time to have a look at some of the threads by people taking action against your same Bank, very helpful. Remember, any threads you want to follow, you can either choose the thread tools button, and choose subscribe to thread, or simply whenever you make a post in a thread it will automatically subscribe you to that thread.
On the main page I've posted above, you'll also find lots of highlighted "stickies", which have lots of very informative stuff in them too.
Once your ready to start , you’ll need to do a schedule of charges to submit to the bank, try this one: http://www.zen122856.zen.co.uk/CompoundSheet_v1.9.xls

In short YES, the Business claim letters are different !
Mainly, you should be careful not to make refernce to any consumer law or cases. ie; you cannot refer to UTCCR 99 BUT you can refer to most else, ie; UCTA 77, SOGA 82 , Common law and most cases used in consumer actions also.
Take a good read of this thread and the other info I have posted you. There are also some sample templates on this thread, and some refernces to other useful threads within,

Im now in the process of getting together my business claim with the co-operative bank, the claim is going back to 1996 and although I hoarded and kept all my bank statements the same cant be said about the terms and conditions I recieved when I opened the account, so if any one happens to have a copy of these Ts N Cs for a business account from around 1996 I would be most grateful to recieve a copy... Thanks to all...GC |
