Default NatWest cardsave merchant services-agreements

I am looking into this for my brother-he is a sole trader of many years and has been using the merchant services provided by his own bank (non RBS NW) for a number of years.
Following a routine call he was impressed by figures quoted by the cardsave rep and an appointment was made.
The rep went through the details and the agreement was signed.This is a membership agreement and contains terms and conditions.My brother was under the impression that Cardsave would make all the arrangements involved in a switchover and that he did not have to do anything,although its accepted that in the terms and condtions there is reference to him checking any notice requirements or cancellation fees from the existing provider.
After 12 days the terminal and point of sale arrived but he noticed that his previous serviceswere still live and ongoing.He called cardsave and was more or less told that this was his problem and not theirs.Asked about cancellation he was told that it would cost him his 70.00 in forfeit for membership (already paid)..120.00 cancellation admin fees and also the costs of returning the terminal and other costs incurred.The terms and conditions appear to support this.
He has not used the equipment and feels that he was missold the package.
Cardsave is an arm of the RBS group who are of course regulated by the FSA.
Has anyone had problems such as this ?
Maybe theres a case to ask for a pre estimate of these charges/fees to demonstrate they are not a penalty.
Thoughts please.
