Default Restarting My Claim

Hi

I started a claim with llloyds last year, my prelim letter was dated 08/03/2007. But my son was killed in a hit n run and i never followed it through. Well i,ve been revisiting this site again and i now have the bit between my teeth again.

I have read that claims for business accounts are not affected by the on going court case. Is this correct?

And also do i have to start the claim again?

I think It would be easier to start again at the LBA stage, Just so you know you have done it correctly.

I have no idea about Business Accounts sorry

Hi i,ve been swatting on here, but can anyone point me towards a template for LBA letter concerning business accounts.I believe these are different from the normal LBA

And also do i correspond in my business name ( sole trader), my name or both. the account was in my business name.

Hi WMHG,

There's been some doubt about Business claims since the initial OFT ruling. However, there have been a few payouts recently.

Business Claim - FAQ's
A guide to Business Claims
Business version letter to your bank -
Sample letter to your bank - business version

Business claims can't rely on UTCCR so that's left out of the letters. Also if any letter still refer to penalty charges, leave off the "Penalty" bit.

Up until the Initial ruling on the OFT case, it was felt that Business claims should not be Stayed as with personal a/c claims, ie they should proceed to court.

After the ruling, which stated that the charges were not Penalties, it was felt that Business claims were no longer viable as they relied on this.

But we've seen cases still being settled, both by the FOS and by the banks direct.

Have a read of threads in this forum, particularly this one, where you could ask for views as well - Claiming on a Business account? Lets join forces?

Hi, butting in on your thread here

I followed the link for a guide to business claims and at the top it says Unfortunately, following the decision in OFT v Abbey and others 2008, it is no longer advisable to reclaim charges from business accounts.

Does this mean that we are no longer able to claim refunds on business accounts?

Hi Fedup

After the initial OFT ruling which said bank charges were NOT penalties, Business Claims looked unviable as they relied on this element.

However, there have been several cases since then where banks have paid out.

Please start your own thread giving a brief history of your claim, whether it has been started, etc. You'll get opinion and advice there.
