Default Tiscali demands

I was so glad to be rid of tiscali (and that was hardgoing-they wouldn't let me cancel even though I'd given written notice, they wouldn't give me a migration code- it ended with me arguing with the manager on the phone who cut my connection off there and then!)
This was 2 years ago. Now, I paid what was due and more- considering I also paid for the time when I had no connection for nearly all of the month (when he cut me off.)
It started many months later....they began sending me letters demanding money. As it was a long time since I had a service with them, the first demand I actually paid because I couldn't remember and thought it an oversight on my part.
Then more arrived.
I ignored them like it said to- if I'd paid the amount.
Then threats to court appeared.
Eventually, I got my info together and sent several letters with proof of the cancellation etc to the manager of tiscali (at highest level) and to customer services.
I threatened them in the letters with harrassment and fraud.
SHOCK, I had an apology!!!!!!

That was last year.

Guess what?

I received a letter at the beginning of this month (may) once again demanding money. This time though, it's not just for a broadband connection but apparently I now have a phone service with them!!!!!

What can I possibly do to get these vultures off my back for good. I did all the correct things before and it's happened again so what was the point?
The next letter will be a threat to cancel my non exsistant service and then a threat to court.
Do I ignore?
Do I wait till they ty to take me to court?
Do I go to the police?

Help please. Anyone?

Personally, if you still have all the proof, then I would let it go to court, but you will get a lot of harassement before that happens and probably defaults issued as well.

Someone else will be along with a more sensible answer soon.

I've just written a summary to trading standards (online) but I'm not very hopeful of any outcome. If they apologize, they'll then send me a bill about.....6 months later for more money and well, if they don't apologize, it would cost money to sue. The small claims court is apparently only for those who want money from the company or person. What do I call this? It's just harrasment. Perhaps I could sue for compensation for the hassle and stress. Don't know. They're a bunch of dickwatts.
Any tiscali viewers here who claim you're a perfect compny, if I get no joy,I'm sending my PROOF to the media. For goodness sake, I've been with virgin.net for 2 years! Your apology letter will be brilliant to send in to something like watchdog, followed by your next letter for demand of money for no service whatsoever.
If I was on the street and someone demanded cash off me, I'd report it to the police....what's the difference? I don't get beaten up!!!

Keep hold of all of your proofs of payment etc

It sounds like you are going to need them for the rest of your life.

Regardless of whatever else you do, I would write to tiscali, remind them of the history and the appology that you received last time. Then add a bit more history - although you thought that you had paid all bills up to date when you left, you paid their first demand when you received it just in case you were wrong. From their repeated demands it has become obvious that you probably had paid in the first place, and demand that they repay that amount.

Sorry, I know that is no help with your current problem ... I would be inclined to agree with Conniff's suggestion making sure that you keep every scrap of paper relating to the issue so that when it gets to court (if ever) you can systematically decimate their particulars of claim.

It's really crappy though isn't it? One should be able to get on in life without some dimwits thinking they can con you out of money you don't have. And, I don't have it to give to them. Is this what leads to war? Because my next investment is a gun to keep any bailiffs out if they send them!!!!!!! Have to say that is a joke...but.....

May be interesting to send them a Subject Access Request (just modify this bank one http://www.consumeractiongroup.c o.uk/forum/bank-templates-library/516-1-data-protection-act.html <here). It'll cost ya a tenner tho but if you get all the information they hold on you, including termination, you are then fully armed to request they go fourth and multiply
