I guess its my turn to follow suit and reclaim from Brightouse, I will be interested to see if I am as lucky as Steven4064 whose thread I will be re-reading for help on this....

I have not applied for an S.A.R as I have all reciepts so I will be sifting through my mountains of paper and will tell you the out come once me and my trusty calculator have finished adding and subtracting

Finished totalling the Fees - £210.60 but need to work out the amount of OCS paid on the exchanged laptop as I paid the contract off early...

Contract started 3-8-07
@£9.99 over 36 wks
charge £214.24
with OCS £359.64

Contract Cleared 19-9-07 strange also is I can not figure out what the total sum was as there seem to be some discrepancies with the early settlement the receipt says Due 298.27 Disc 115.00 Fees 2.70 total is 125.97 yet Total amount paid was 201.35 which included 15.38 on another contract

The chances are they only charged OCS on the remaining money owed and not the money previous received for the faulty laptop but how would I work out what to claim back or do you think its best to leave the OCS charges as they already robbed themselves in their overzealous attempt to rob me or in fact am I the one whose been robbed Lefty what you think?

I dunno.. Which is why you may have to go through the traditional S.A.R - (Subject Access Request) route... You'll have far more accurate data to work with - plus BrightHouse can't try stalling by disputing any figures/totals you present to them...

Lefty...What would an S.A.R get me that I don't already have?...I have all contracts and all receipts. This is how I had one over them the last time when they said I had paid less than I had actually paid, I took all my receipts into the store so he could add them up in front of me. Even the employee said he was shocked as most of the customers he dealt with had at least a few missing and usually none had receipts that went back to the start of the contract.

If I tried going off their figures £359.64 - £214.24 = £145.40 over all charge for OCS which has a weekly payment of £3.50

£3.50 * 36 wks = £126 so already I can see the OCS has been over charged by £19.40 However I have spotted on the agreement it states

H-Total Charge for Credit (all of which is interest) £19.40
A-Total Amount of Credit £214.24
D-Total Amount Payable £233.64
Annual Rate of Interest 29.9%

Weekly payment over 5 weeks @ £9.99 receipts = £61.37 of which £17.50 of this is ocs . Plus my first wks payment shows a charge of £11.42 with £10.00 Disc & £10.00 Fee and I can guess as the date fell on a Friday I have been charged £1.43 in order to make it a 8 day payment.

I have just had confirmation from the store that OCS is not calculated in the early settlement and thus ends same day.

This then raises the problem that the early settlement due figure £298.27 which calculation shows is the total included remaining OCS but the £115 discount includes £108.50 of the cancelled OCS meaning my early settlement discount is £6.50.

on £233.64 -Total Payments £43.87 - Discount £6.50= £183.27 + 2.70 = £185.97

I knew I'd figure it out in the end but it took me all day Now the question is does anyone see £6.50 as an adequate discount on settling so early?

Ignore that the item says used, apparently the manager claimed that there was no way the boses would go for the agreement he made with me i.e. giving me a new laptop considering what they were selling them at, at that time and as my previous money from the faulty laptop was put onto the agreement however I have since realised he did not reflect it on this contract.... but importantly the contract tells me I have NO statutory rights?? Is that legal to state this to customers?? And also only receiving £6.50 REBATE when only a few weeks has elapsed on the contract.

Update: Its soon time to issue my second letter to Brighthouse as yet I have had no responce to the first so I guess they are intending to ignore them.

Why not apply now to buy the products you have always wanted - without the traditional credit strings attached! Below are a few points you may like to consider before applying.

- Do You need the product if you cant afford a 42" tv (triple the price with our guarenties) then buy a 28" from asda and save over £700 plus get useful insurance

- Can you provide referances.

- sre you prepared to have your door kicked in if your more than £2.50 behind

- Are you prepared to have long and pointless arguments with a brick wall wearing a managers hat to get your legal rights?

- Are you prepared to accept shoddy goods without the need to check them for the invevitable damage

- Can you make it into town at random times on days when you think were closed to pay or face a knee-capping

- do you have any close relatives we can hold to hostage if you threaten to cancel insurance (may accept pets)

- credit may be refused if any legal rights mentioned

Well 1st it doesn't matter that they are unable to open attachments as at least hard copies were also sent however it took them this long to acknowledge the original letters, says a lot about the customer service as had they received the email and been unable to access attached documents they could have sent an email asking me to send a compatible file

Late payment charge explanation seems to be the same as Steven had

As for explanation of the laptop case, Both the Area Manager & Manager made the option service cover as part of the arrangement for new Laptop, I think they need to go back through all correspondences for last year where I even named names And the Manager himself infront of my witness admitted he knew of the problems with these laptops therefore is that not admission that they know what they are supplying are substandard as these Infinity laptops are a Brighthouse own product....does anyone know if they are still selling infinity's ??




According to Consumer direct the store are allowed three attempts to fix an item, they had two and in the first ripped out a part out of my machine, yet she failed to acknowledge that lol

Why the hell would I want their service cover and I forgot to give you the joke once I paid of my washing machine how much they were offering to cover my machine for a week erm I don't think so!!

And as far as breached terms....they were given the opportunity to take me to court and did not take me up on the offer I wonder why now they think they will scare me into not taking them to court by their threat of recovery, if people look through all the different threads I have on CAG people will see I am having a rough time from all directions of late if I don't stand up for anything now I may as well give up!!

I still have some fight in me considering all the stress I am in and its my fighting that's giving me purpose right now otherwise I think I would have lost my mind already
