Default Any Advice On This One Please?

Hi everyone!

Rightiyo, I think most of my estate use Brighthouse! It's only through having problems of my own with them you find these things out in conversation.... Anyway..... A young mum across the way from me bought 2 mobile phones from them at xmas, one for her son and one for her hubby. Basically they are tripe, they don't work properly, falling to bits etc. Shes rang the store and told them shes returning them on Saturday. (she's not in arrears by the way)
They've thrown a wobbler and told her that she has to pay for them this week????? Her argument is that the damn things are neither use nor ornament and she wants rid end of story. Shes now worried about returning them. Surely she can can't she? She's up to date with all her payments too and has all the covers included in her agreement. She has a cooker too that is nearly paid for.

Companies like this (and sometimes more reputable ones) like to kick up a fuss to try and put you off. They don't want the extra work or loss of profit.

Yes of course she can take them back if they are faulty.

If there is any signs of abuse of the phones however, she will have the devil of a job to convince them it is a faulty phone.

Your friend has two options:

1 - If she has the optional service cover and damage liabilty cover on the agreements, she can simply return them and tell BrightHouse to bugger off! She will lose any money she has paid on the phones, but that's hire purchase for you!

2 - She can invoke the power of the SUPPLY OF GOODS (IMPLIED TERMS) ACT 1973 and, also, make good use of the optional service cover and damage liability she is paying for and get the phones repaired/replaced as appropriate. (Bearing in mind Conniff's advice regarding any own damage)...

Personally... I would go for option 1...

Cheers Lefty. What makes me laugh is, they'll probably complain and say it's her fault yet they flog bunk beds in there that 100 kids bounce on every day in their store! The ones with a price on too which some poor bugger will get lumbered with no doubt!!!!!!!

Yep

And, whenever BrightHouse telephone you, ALWAYS advise them (whether actually true or not) that the call is being recorded! It has an amazing effect, believe me!

Not necessarily. Depends which plastic gangsta we deal with on the day.
