Hi i contacted brighthouse by letter both the local shop and there head office Caversham Finance Ltd asking for the optional service cover and the Damage Liabillty Cover to be removed
this evening we recieved a phone call from the local store stating they had recieved a fax from head office asking for this to be done
they stated on the phone that we would need to provide them with a copy of our household insurance stating that the item would be covered and that we would need to sign a new agreement before this can be done
After reading all the HP agreement, OSC, DLC knowhere on there does it state that i need to show them my household policy or that i need to sign a new agreement
thats all it states is that i must write to them(already done) cancelling the optional cover
what is my legal stand to this

Contact them again and point out that the terms and conditions state that in order to cancel the optional you need only write informing them and you have done so.

I sent them a letter on sat outlining that nowere in the agreement do i have to sign a new one to cancel I also pointed out that as long i give you 7 days notice that i want cover removed that is my right
I also put Cc to OFT and Pontypridd trading standards on the letter and they where sent copys of what i had sent brighthouse
funny i received a reply today

Quick update from there head office
Sorry to learn that you have been dissatisfied with the service we have provided and i can confirm that i will conduct a thorough invesigation into your concerns
once this is done i will write to you again

Hi welshnutteruk

Thanks for your PM - sorry for the delay in getting back to you, but I see you have already sent your written instruction to Brighthouse to remove OSC and DLC. Have you now given the required 7 days notice? If so, I would imagine your next payment is due, unless you are a monthly DD customer?

Brighthouse could possibly argue that the present agreement you have does include OSC and DLC and, as it is integeral to the agreement totals, a "new" agreement needs to be made.

However, it is VITALLY important that your account is not re-set - thus causing you to lose all your consumer rights regarding early settlement and repossession etc. You MUST insist that any new agreement reflects all previous payments made on the original agreement.

Make sure the store has 2 copies of

1) Your original agreement
2) The "new" revised agreement
3 A copy of the statement below

Staple all three documents together and have both you and the store manager (NOT just a sales assistant) sign all pages at the same time.


Original agreement number XXXXXXXXXXXXXXXX

New Agreement number (you may have to fill this in pen)

Date

Updated agreement to reflect removal of OSC

IMPORTANT Payments made previously on this agreement (XX payments to date representing XX of the total amount payable) are to be reflected, and form part of, any revised agreement.

All rights rights under the Consumer Credit Act 1974 regarding, in particular, “early settlement” and “repossession” as set out in section J of the original agreement remain intact and continue uninterupted into any revised agreement.

Signed - YOU
(Print name)

Signed - Store Manager
(print name)

If the store manager refuses to acknowledge your "addition" to the new agreement, then YOU should refuse to sign any new agreement also.

Hi Lefty
In my first letter a stated that i was giving them 7 day notice to cancel the cover
having read many times the agreement NOWHERE in there does it state that i HAVE to sign A NEW ONE to have the cover REMOVED
thats all it states is if you want to cancel you MUST do so in WRITING GIVING US 7 DAYS NOTICE
I know what you are saying in your post but if it doesnt state it in the agreement why should i after i wrote to there head office out lining this we recieved a call today saying that we will need to speak with the manager for him to alter the payment amount on the computer but if they need me to sign a new one they will have to post it to me as i int traveling 40 miles to sign one they wanted to be a pain so i will

I completely agree with you, and do see your point...

But, as we all know, Brighthouse manage to work "just within the law" and will exploit any loop hool they can find. And, in your case, the signing of a new contract (because you've had the NERVE to request the removal of service cover!!!!) will give them the opportunity to strip you of your rights regarding early settlement and repossession. That is, IF YOU LET THEM!!!

Because your original contract is made up of a hire purchase agreement, service cover agreement and damage liability agreement combined into ONE agreement, it's not so unreasonable for them to require the signing of a revised contract.

However, what IS important, is that you insist they apply the additional terms below.

Original agreement number XXXXXXXXXXXXXXXX

New Agreement number (you may have to fill this in pen)


Date

Updated agreement to reflect removal of OSC

IMPORTANT Payments made previously on this agreement (XX payments to date representing XX of the total amount payable) are to be reflected, and form part of, any revised agreement.

Hi Latest from brighthouse head office on Friday
The store manager has agreed that there is no problem with removing SC & DLC and i would need to sign a new agreement
with the amended terms (safe gaurd my early set and other part j) so i told her where in the agreement does it state that i have to sign a new one she told me it doesnt(that i knew) and that i would need show them that its covered on my home insurance it doesnt (that i knew) i told her to tell the store to post out the new agreement and i will show it to trading standards and if its ok and im safe gaurded i will sign it and post it back
she told me no problem
anyway i contacted consumer wales who spoke with trading standards and they told me that I DONT HAVE TO SIGN A NEW ONE AS PARTS A, B, C, D, SET OUT THE TERMS AND REPAYMENT AND THAT THE SC AND DLC ARE IN OTHER PARTS
anyway waiting for trading standards to contact me about it and they will take it up
had a phone call sat morning of store manager and he will BRING THE AGREEMENT TO MY HOUSE FOR ME TO SIGN (i told him put it in the post he told me noway i told him ok dont bother i will just wait till tarding standards contact me as i have a letter from your head office (sat post) saying you will lets wait and see his next move

Greetings folks!

Hopefully, we will have successfully lured you back to this thread via a “new post” notification email!

We are trying to collect stories of people's experience with Brighthouse. Eventually we would like to make up a dossier.

We would like to know about how Brighthouse staff have treated you, particularly if you have got behind with payments.

We would also like to know if you have been pressurised to take out any insurance or optional service cover (OSC).

Furthermore we would like to know about problems you have had with goods from this company and how Brighthouse have handled repairs or replacements.

Had a letter back from the FOS stating that they have sent back all the details and have written to caversham finance (Brighthouse) to ask them to respond within 8 weeks called FOS up asking why she said they must give you a response to your compaint i told her they have and there final response was enclosed in the file OOH im sorry send it all back and we will take a look again we must have missed it so off it all goes again
