Hi Just a update
trading standards have spoke to brighthouse and they sent her a copy of my agreement (she has a copy off me too) right here is the problem when they put my agreement together the put 2 pages the same in there so mine doesnt have section 8 in it
just spoken to TS Lady who said it is in theres i told her but its not in my and has its a legal doc surly it is a lawfull doc its brighthouse jis fault that they didnt put it together properly and another thing when they send the new agreements out they altered the settlement figures so it does not reflect what we have already paid also in the envelope was a copy of A INTERNAL EMAIL FROM THERE HEADOFFICE TO THE STORE LETS JUST SAY THEY DONT SPEAK HIGHLY OF ME IN IT!!
ok what would be my best move now as any company could change/add anything to a agreement and then say you must have lost a page so where does the law stand on this surley once you sign a agreement and the T&C surley you must abide by them the lady from TS i think is young as when i ask her something oh il speak to my boss and ring you back
so can somebody help what about the OFT??

Brighthouse could possibly argue that the present agreement you have does include OSC and DLC and, as it is integeral to the agreement totals, a "new" agreement needs to be made.

However, I think the term to be applied here is a REVISED agreement!

It is VITALLY important that your account is not re-set - thus causing you to lose all your consumer rights regarding early settlement and repossession etc. You MUST insist that any new agreement reflects all previous payments made on the original agreement.

Make sure the store has 2 copies of

1) Your original agreement
2) The "new" revised agreement
3 A copy of the statement below

Staple all three documents together and have both you and the store manager (NOT just a sales assistant) sign all pages at the same time.


Original agreement number XXXXXXXXXXXXXXXX

New Agreement number (you may have to fill this in pen)

Date

Updated agreement to reflect removal of OSC

IMPORTANT Payments made previously on this agreement (XX payments to date representing XX of the total amount payable) are to be reflected, and form part of, any revised agreement.

All rights rights under the Consumer Credit Act 1974 regarding, in particular, “early settlement” and “repossession” as set out in section J of the original agreement remain intact and continue uninterupted into any revised agreement.

Signed - YOU
(Print name)

Signed - Store Manager
(print name)

If the store manager refuses to acknowledge your "addition" to the new agreement, then YOU should refuse to sign any new agreement also.

Hi Lefty thats the problem when they put the agreement togehter the put in the wrong sheet of paper my contract doent contain anything about OSC & DLC
they are 2 seperate ones at the back T&C for SC & DLC and thats all it states is i must give 7 days notice to cancel they flopped up when they put the agreements together so my T&C in HP Agreement does not state i have to show home insurance and i would have to sign a new agreement
other point i had with SC it sates that if the item cannot be repaired in your home we will leave you a loan item i had my item taken away twice for repair(12 weeks) and no loan item
and they have sent me 2 new agreemnets to sign 1 contains 9 pages other 1 contains 2 stranger how they can then add there T&C in the 2 page one also they have reset the account now to outstanding balance 232.00 so i would need to pay so much again
just waiting for a phone call ask why they in had the agreement
thats why i need help i want to go straight for the throat and if i can beat them i will give the papers my story so others can do the same

Greetings folks!

Hopefully, we will have successfully lured you back to this thread via a “new post” notification email!

We are trying to collect stories of people's experience with Brighthouse. Eventually we would like to make up a dossier.

We would like to know about how Brighthouse staff have treated you, particularly if you have got behind with payments.

We would also like to know if you have been pressurised to take out any insurance or optional service cover (OSC).

Furthermore we would like to know about problems you have had with goods from this company and how Brighthouse have handled repairs or replacements.

Ok update on what has happened to date(sorry int updated before int been well)
TS Agreed with me it is down to brighthouse to check both agreements before i sign they failed
OFT they investigating all my complaints and i had to write a statment
but they cannot tell me the outcome has they will deal with a few complaints at one time against them
FOS waste of time had a letter back today from them
Quick breakdown
we are sorry to tell you that you compalint is not one we can deal with we can only deal with these compalints after 6April 2007 and cant deal with mine as the agreement was signed in Oct2006 so we are unable to deal with your compalint
ok now the latest
we always pay on the sat
Payment due on 16th Aug we missed payment on the 18th we had a call from them about it £7.79 + late payment £2.70= £10.49
we where told no its £18.18 payment late charge this weeks payment total £18.18
I stated that THIS WEEK payment not due till Sat was told i cant take anything less that £18.18 told them you will have 10.49 today and the other 7.79 on sat when due was told ok will put the part payment in yellow money and wait untill Sat before it goes on the account i stated no i wish to make a payment of whats due on my account and do not want it going into yellow money was told ok fine cannot take your payment and they put the phone down
So i sent a email (weds)to head office anne Healey stating that they refused payment reply back sorry your unhappy about or service i will investigate and contact you
Gets a call from brighthouse on thursday asking why we not paid told them you refused payment as only 10.49 was due and other 7.79 due on sat
she told me cuz 1 payment late you have to pay for other week same time told her the same will pay whats due she refused payment so i told her fine i will wait for there head office to call me back
nobody did get a letter today stating
NOTICE OF INTENTION TO INITIATE LEGAL PROCESS
OUTSTANDING DEBT £26.07
as we have broken the agreement
ok anyone help on this when i asked for SC & DLC to be removed in Jan 08 they wanted to reset the account i refused they sent out the new agreements and i still have them as i would not sign them
so how can i break a agreement that they dont have??
other part of letter states our intention to recover the goods and arrears
anyone shed any light on this as i want them to take me to court so that i can go and defend myself over theses jokers
PS there is only £39 total outstanding on this account
and they other part that i want to fight is when we took out the agreement there was a leaflet in there stating if your item breaks and we have to take it away for repair we will leave you with a loan product they failed to do this and we where without a laptop for 12 weeks knowhere does it stated laptops are not covered
i will not leave these beat me
also if you work out what they say is due
7.79+ 2.70 late payment that was due on 16th
7.79 due on 23rd no late payment charge on that
7.79 due on 30th
funny only one late payment charge ??
PS the store does know that FOS and OFT are dealing with my case int told them its finished and they also knopw i dealing with head offices

Quick update today call from brighthouse yeswe agree if you pay whats owed and then make you payment as normal on sat
Asked her on the phone for a copy of Initial Disclosure document and needs and demand staements that they need to keep when you take out the DLC & SC didnt know what they were we dont do them
My reply ok ask FSA do you need them also told them please take me to court so that i can present my case and not to phone or write to me again will only deal with head office
Managers reply surly we can resolve this without going to head office or court sorry you need to read up on laws not me and look forward to seeing you in court
and i hang up
bet i get a call from head office
PS also stated he would not charge me late payment fees how strange

Ok phone call today from shaun at Brighthouse head office
only contacting you to see what the problem is,
Told him everything and that i have updated OFT and FSO
also that have contacted TS and FSA has number 1 you give out a leaflet when you take out DLC and OSC stating that if your item needs repairing and we need to take it away we will leave you a loan product no where on the leaflet does it state laptops are no covered so i will contact TS
Number 2 When taking out OSC & DLC we should have signed a intial disclosure documnet and needs and demand FSA Laws you failed again
Also told him go to OFT website not the first time they been done by them
told him that no payment will be made on the account and to set a court date so i can present my case or i will call in the court and take brighthouse to court His reply im sorry we wont take you to court let me get back to you
i reminded him that the law allows me to record phone calls without the other person knowing (harrasment by telephone act)
so lets wait and see what he does

Ok update had a call from BH head office today
sorry to hear you have a complaint against us and are not happy
has the account is in the wifes name I DONT WANT TO SPEAK WITH MR ONLY MRS wife told him you deal with MR its my choice he comes on the phone

its about your account dont be silly and just pay us the £47 pound you owe

OK what if i do you a favour and knock 27 off what you owe and you only have to pay me 20

If you where to knock £47 quid off i still wont take up your offer
so please can you take me to court so that i show a judge how your company act to customers
well i wont take you to court and put the phone down
this is where i need help he reckons they do not have to supply me with a copy of the intail disclosure doc or needs and demand but i read on here somewhere that they do its law by FSA
i want some details as im prepared to take them to court over the OSC and DLC
any advice on how to go about this
so i can send them a letter before legal action

Hi all had a letter today from there head office Anne Healey Customer services manager
further to your complaint we have now investigated your complaint fully
the regional manager has now confirmed that he has now terminated your account
plaese note that under the terms of our complaints procedure this is our final response

Fun how i get a letter like that after i sent a letter before action
asking for initial disclosere doc and needs and demand statments also for a refund of all my OSC and DLC

Simply because BrightHouse have terminated your account and, in effect, written off any outstanding "debt", does not mean you can't still persue THEM for a refund of all OSC policy payments you feel are owed to you. All financial transactions made between you and them will still be available for scrutiny for the next 6 years.

If they won't take YOU to court, you take THEM to court.

Go get em, tiger!

i want copies of needs and demand and intial discloserue doc ok reply back today
if they reckon they not covered by UK laws has there are a malta based company how can they use uk laws when people dont pay

Ok this went off to brighthouse today
Dear Sir/Madam


I write to you with regards to complaints I have with Brighthouse
I took a agreement out with your company on the 7th October 2006
I was told that I had to have OSC & DLC having had the goods and gone home I found out this was untrue and we where miss sold this also we where given a flyer stating that if your item breaks down we will give you a loan product. Nowhere does it state laptops where not covered, the laptop was sent back twice for repair and we where without it for 12 weeks.
We where also missed a payment that was our fault and we except that payment is made on a Friday or Saturday when we called to pay on the money we where told you would have to pay £7.79 + £2.70 late fees I told them ok it was my fault she then told me payment was now £18.18 because we where late paying and have to pay this week as well I told them no I will pay £10.49 and the £7.79 on Friday when it was due they then refused to take the payment and hung up. On the Friday we received a letter stating that we owed £26.07 because we would have to be for the coming week, nowhere in the agreement that if have you made one late payment to have to pay the followings week as well? I found parts of your letter to be intimidating where you state you will repossess the goods why did you not mention that you would also need a court order for this? You say notice of intention to initiate legal process and had a customer service guy call me up and made me a offer to pay off have what was outstanding 6 weeks I told him to go ahead with court action as I will be turning up with legal representation to defend my case. I then receive a letter telling me my account as now been closed as you will be aware I am prepared to take this matter to court and also report this matter to the OFT as it is not the first time they have dealt with this company after viewing there report on there website, I now seek full repayment of all service cover (OSC & DLC) £390.00 and as a gesture of good will I will not seek repayment for the 12 weeks I was without my laptop and will allow you to use this towards the 6 weeks outstanding payment on the account you closed I look forward to your reply within 7 days failing that I will send you a letter before action and then seek redress through the county courts
Also I asked for a copy of the initial Disclosure Documents and the Needs And Demand Statement that I signed to simply state in your letter you are not regulated by the FSA UK is untrue as a quick check of there website will reveal I hope you will give this letter your full attention and await your reply
