    • Thank-you dx for your feedback. That is the reason I posted my opinion, because I am trying to learn more and this is one of the ways to learn, by posting my opinions and if I am incorrect then being advised of the reasons I am incorrect. I am not sure if you have educated me on the points in my post that would be incorrect. However, you are correct on one point, I shall refrain from posting on any other thread other than my own going forward and if you think my post here is unhelpful, misleading or in any other way inappropriate, then please do feel obliged to delete it but educate me on the reason why. To help my learning process, it would be helpful to know what I got wrong other than it goes against established advice considering the outcome of a recent court case that seemed to suggest it was dismissed due to an appeal not being made at the first stage. Thank-you.   EDIT:  Just to be clear, I am not intending to go against established advice by suggesting that appeals should ALWAYS be made, just my thoughts on the particular case of paying for parking and entering an incorrect VRN. Also, I continue to be grateful for any advice you give on my own particular case.

BUT... in some instances, like this one...you dont quite match the advice that the forum and it's members have gathered over a very long consensual period given in a tried and trusted consistent mannered thoughtful approach. one could even call it forum hi-jacking and that is becoming somewhat worrying . dx
    • Yeah, sorry, that's what I meant .... I said DCBL because I was reading a few threads about them discontinuing claims and getting spanked in court! Meant  YOU  Highview !!!  🖕 The more I read this forum and the more I engage with it's incredible users, the more I learn and the more my knowledge expands. If my case gets to court, the Judge will dismiss it after I utter my first sentence, and you DCBL and Highview don't even know why .... OMG! .... So excited to get to court!
    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other! One other point to note, the more I read, the more I study, the more proficient I feel I am becoming in this area. Make no mistake DBCL if you are reading this, when I win in court, if I have the grounds to make any claims against you, such as breach of GDPR, I shall be doing so.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, I would like to know if anyone can advise me. I really don't know what to do.

 

On 23rd September, I had a medical assesment with ATOS, this wasn't my first, and so I was dreading it.

 

I've suffered with depression and anxiety for the last 4 years, and find it very difficult to get out, and socialise, so you can understand why it was difficult attending the interview, let alone regular social events.

 

Anyway, I've had medicals with ATOS before, but every time I get the results back, I lose my benefit saying I didn't score enough points. Out of the 15 points needed, I usually get about 10.

 

However, I assure you, how I answer the questions, and how they are marked on the answer sheet are two completely seperate things. I appealed twice before about this, and both times was found in favor of ATOS Healthcare. I'm lying, apparently.

 

However, I got the results today for my medical on 23rd september, and my results were byond a joke. I scored NOTHING, out of 15... ZERO...

 

My arguement is this... if I was a benefit fraudster, and was trying to convince them I was ill, when infact I wasn't... why would I answer questions, saying there was nothing wrong with me, like the Doctor has marked down.

 

The DWP said I can appeal, which I dont see any point in doing, as it's there word against mine, I can get a crises loan, which is pointless, as I wont be able to pay it back, or go on Jobseekers allowence, which I dont want to do, as I dont feel able to attend the interviews, let alone find a job.

 

I feel like i'm fighting an impossible battle here. I don't know what to do... i have no money coming in.

Sorry to hear about your trouble with ATOS. I had exactly the same problem with them and having my money stopped.

 

I have nerve problems in my arms/legs and arthritis in my back and knee's and a tendon problem with my right hand yet I didn't get a single point myself.

 

First thing to do is call up ESA and ask for the forms for an appeal. Remember you only have a month to ask for it. Also ask for a copy of the report the doctor gave to DWP to see exactly what they put.

 

When I got mine I was not so mildly surprised at the lies that were on the report by the doctor. Which is another thing you could add to the appeal form. On mine it says I can kneel and squat fine which I can't and there were questions answered that he never asked me. I mentioned this on my appeal form so they could see what a liar the "doctor" was and why I disagreed with the decision.

 

I don't know if you can do what I did and that is to attach letters/reports from your doctor to the appeal form when you do get it.

 

Don't let them beat you.

 

While appealing the decision you should get some money off of ESA.

my several posts and comments on here tell my tale of atos, i was found unfit on my first 2 tests and miraculously fit on the 3rd, i think at this point in time its all about getting long term or longish term claimants off IB, saving money etc, as advised above all you can do is appeal, fight this, and get some benefit while doing so, if ESA is better then go for that, i asked for my income support element of my benefit to be reopened and get the reduced amount of IS while in appeal awaiting tribunal hearing, good luck, and please let us know how you get on.

Hi PB, you'll certainly find a lot of help and support here!

I wonder why you failed your last two appeals? Perhaps you were underprepared? Maybe you didn't have an advocate with you? Either way, no reason not to appeal again.

Do return the appeal form promptly, don't worry if you can't send all your evidence off immediately - your appeal will be many months away - the tribunal service just needs to know what you want to do.

Then concentrate on finding as much supportive evidence as possible. Whilst the DWP decision makers can selfishly disregard professional medical opinion, the tribunal will want to see it. Ask your GP if he/she will write in your support. Do you see any other healthcare professionals? If so, do likewise. Even statements from people you know would not go unnoted. It all helps to paint a picture of what you're really like.

And do get professional assistance from a welfare rights organisation or CAB.

I suffer from chronic back and right leg pain and have developed agoraphobia. After many phone calls and two aborted medicals because of panic/anxiety attacks just before going I got my GP to write to them asking for a home visit which in the end they agreed to. I saw a Dr with my son present in my house. I was about to appeal his report as he had mentioned nothing about my mental condition and was put on the work activity group I got another phone call to say that a Dr would be doing a second visit to see if I qualified for the support group. Guess what the same Dr turned up! I really emphasised my emotional state and I await to hear the result!

I know it`s a bit late for you now but good luck and don`t give up.Good luck.

Hello PB. I'm so sorry to hear about your problems.

 

I appealed against my ATOS medical report and won, but not until we went to a tribunal to appeal against the DWP decision. They had stopped my benefit [incapacity] and like you, we also thought it was in an effort to get people off sickness benefits.

 

My husband was at the medical and so was able to endorse what I said about the meeting with the doctor. We asked for a copy of my assessment and then found the part of the DWP website that shows how they allocate the points. If you can't find it, please let me know and I will have a look and send a link.

 

We wrote a letter saying why we disagreed with the answers the doctor gave, which went to the tribunal. It was a pretty short meeting with the doctor, and a lot of time was taken filling in answers on the computer that presumably enables the assessment. We tried to keep our comments to the tribunal factual and look at the doctor's answers the same way the DWP system does. There were some inaccurate details about me on their form and the doctor even contradicted himself at one point.

 

If you don't already, I really encourage you to have someone with you at any meetings concerning this; it's moral support for you and also a witness to what goes on, should you ever need one. I could never have done all this without my husband and he was present every time.

 

I'm rooting for you, don't give up.

hi honeybee, i am still waiting my tribunal hearing date, am a bit worried as have read comments people have made about being aware of the procedures as its so very important, i dont have a clue what this means lol i had nobody with me at the atos test, and the answers i gave were not put down, i have since got letters from specialists in mental health to back my version of it all, the tribunal have all my evidence, am just wondering what procedures i should know about before i attend?

Sorry to hear about your plight with barbarian dwp and atos. I too have had to go through the same and understand how it does make you worse. I would advise for any future medicals you always take someone with you so they can be witness and support for you. Apply for your appeal, it will take about 9 months but in meantime they will continue to pay you at the basic assessment rate. Get all the medical evidence together you have and also contact welfare rights if you have one in your area they will help. They helped me and got mine overturned. Good luck with your appeal and keep us posted you will get lots of support on here.

Do not give up, keep fighting !!

 

I have a friend who is housebound due to a medical condition.

 

ATOS scored him ZERO.

 

His GP went absolutely mental !! Of course he has appealed but been told about 9 months before a hearing but meanwhile will still get the lowest rate until the appeal is heard.

 

It is unbelievable that this lot are allowed to get away with this !

 

I hope everyone keeps flighting for their entitlements !

I too have had a good experience claiming ESA © was awarded it straight away and put into support group. I too was worried but if you are a genuine case you honestly have nothing to worry about. x

 

Just noted this posting on another website. Someone has figured out where we have all been going wrong! None of us is a genuine case - we are all scoundrells, vagabonds and thieves!!!

 

So the system does work - but only for those that are genuinely ill and incapable of working. They got the legislation right after all!!!!!!

Thanks loan ranger thats a pretty good link - I've read about 50% and will pick it up tomorrow.

I'm sure I'll be subject to another ATOSH 'medical' in due course. I'm thinking do I need to submit myself to a fake computerised 'medical'? Is there an alternative? What if there is a power failure, is there a paper back-up?

More interestingly, what would happen if I pulled all the plugs from the PC and said 'Let's do this the old fashioned way?'

Very very tempting ... [after all, I'm going to score null points anyway...]

I'm still on IB and get a bit extra in the form of the age allowance. Under ESA the age allowance has been scrapped meaning that even if I can get into the support group I will still end up with a few quid less than I'm getting now. When David Freud announced his intentions for ESA (in October 2007) he said that no genuine claimants would find themselves financially worse off and that the support group would be financially better off - another lie which some gullible charities were naive enough to believe and act as Freud's cheerleaders.

When my time comes for the move to ESA I'm gonna make them examine me at home so that I can sneakily record the fiasco medical. My argument for a home medical will be that the stress of the ESA process is causing psychosis.
