Default Benefits for an Industrial Accident

Hi guys

Hope this is in the Wright place.

About 3 weeks ago I was hurt at work at no fault of my own. I work for an agency who is employed by our local council in Scotland. I placed a bin on the back of the bin lorry and the driver decided to drive off as placed the bn on trapping my arm and causing my injury. I then had to spend 4 days in hospital and received treatmeant for my arm . I now have no felling in my arm. Finding very hard to simple thing like opeing a can of beans

The agency stated the day that I got in injured that I would only get SSP (Statuary Sick Pay) even knowing that I was not at fault and the council driver was. Two weeks after being discharged from hospital and day before I was meant to get my SSP. I received a form through the door with my sick line from the DR stapled to it. The form is a SSP1 There was no cover letter. Just a few check boxes ticked on the form stating that I am not getting SSP due to not earning enough. I then called the agency to see why when I earn £250 a week that I don’t earn enough. They then told me as I have only been with the agency for 10 weeks that I don’t qualify and I am meant to be with them for 12 weeks before I did.

I have now to apply for incapacity benefit form the DEP which seems only to be £50 pw.
The council driver is still at work getting full pay and I am here about to lose my flat if I can’t keep my rent paid for. I threatened the agency with a newspaper .So in return they gave me 2 weeks wages backdated to help me out. I still feel like no one ether in the agency or the local council gives a toss.

I have contacted a solicitor but they can do is process a claim that takes 3 years to get anything back from,

Can any 1 help with any more advice ????
