Or release some equity maybe? Rarely a good idea.

Plus if you have made yourself unemployed i believe you have to wait 26 weeks before you get anything Can you not read? He had to lay himself off which implies a different scenario to making oneself unemployed. A 26 week wait in this circumstance is rubbish too.

Do you honestly think the state should pay your mortgage for you? Why not? In better times, just by what he has posted, he has employed himself, his son and a book keeper and probably many others.

Do you not realise the construction industry is first to suffer in a recession and last to come out?

No doubt he has paid quite considerable sums during the past to the state and now he is in need.

This is how our system works.

Be more constructive rather than this load of dirge in future.

And what a snidey smilie! Yuck!

Its a subject that gets peoples backs up because we all read about those stories when people abuse and manipulate the system.
Theres no suggestion from what I can see that the OP is doing any of this.
We have to remember that he has not laid himself off work by choice-and in the course of his business life probably contributed lots to the state coffers. You usually find that the dodgers and scroungers are the ones who dont need to come onto internet forums to ask questions about it-they already know the rules inside out.
Callumsgrans suggestion was a fair comment-lots of people are doing this now-downgrading is better than losing all.In the bad times we have to make decisions we dont like-thats life....and something many more people will be facing in the coming months.

For my two penneth

He is the director of the company and owns all the shares. So, it was his sole decision to lay himself off. He has chosen to keep 2 members of staff on out of loyalty (and admirable it is too m and made himself unemployed. His business is obviously still running and generating some form of profit (I presume)

This isnt as straight forward as normal claims but I believe after a bit of digging and tieing loose ends I believe that you wont be entitled to anything

He can claim contribution based JSA of £60 (but not the mortgage interest which is means tested.)

There is a possibility the decision maker may apply a sanction but there is no way to know unless he claims: even if this situation counts as leaving work voluntarily (which is unclear), the OP can still argue it was reasonable.

I criticised Callumsgran's 'advice' because it wasn't advice but, rather, it was clearly a pop at the OP who posted on here seeking advice whilst going through a very difficult time-as are many others.

This attitude is simply because the chap runs a business and has now hit hard times and they are seamingly struggling, despite a wage earner of £35k a year in the household.

Instead of this personal attitude against the OP it should be pointed out the benefit system is for all when needed-even the Gentry of the land can claim benefits.

Callumsgran should have read his circumstances first without just jumping in with bias to admonish.

He laid himself off which is not the same as making oneself unemployed, at least as seen by the DWP.

His business is still running but he has pointed out it is at a loss or just breaking even. Nowhere has he said it is making a profit.

And yes, the state, at least in theory, should pay (toward) his mortgage as this benefit is available to all who qualify for it.

So I would suggest the OP contacts his local DWP as soon as and explain his circumstances to see what help is available although the mortgage interest is unlikely to be paid and even if it was it would still be some way short of his large mortgage as the limit is 100k.

In any case, good luck to the OP for the future.

Umm yes it was advice actually, i advised him to downsize his house as its worth £460,000. Did you read that bit properly Al?

This attitude is simply because the chap runs a business and has now hit hard times and they are seamingly struggling, despite a wage earner of £35k a year in the household. Wrong again, its because there is equity in their property and unless they are running a childrens home or similar they dont need to live in such an expensive property

Instead of this personal attitude against the OP it should be pointed out the benefit system is for all when needed-even the Gentry of the land can claim benefits. Nothing personal at all, i would say the same to anybody else in the same position.

Callumsgran should have read his circumstances first without just jumping in with bias to admonish. Errr i did, did you?

He laid himself off which is not the same as making oneself unemployed, at least as seen by the DWP. I think you'll find its exactly the same thing when you have others working for you, that could be laid off first

His business is still running but he has pointed out it is at a loss or just breaking even. Nowhere has he said it is making a profit.

And yes, the state, at least in theory, should pay (toward) his mortgage as this benefit is available to all who qualify for it. Should they indeed? And why? pray tell? It will be 9 months before he can claim it by which time he could've downsized and released some equity so not sure if he would qualify anyway, although i'm no expert i think that is how the DWP will look at it

So I would suggest the OP contacts his local DWP as soon as and explain his circumstances to see what help is available although the mortgage interest is unlikely to be paid and even if it was it would still be some way short of his large mortgage as the limit is 100k. Good advice

In any case, good luck to the OP for the future.
Indeed, good luck Alan
