Default Refusing to pay back pay - even though it's their error

Hi guys,

Just a quick one....

My sister's husband left her about 2 months ago (well she kicked him out cos he beat her - but that's another story).

She made an ammended application to tax credits, but when they input the data into their system, some muppet put that she earned £110,000 last year instead of £11,000. Making her entitlement nothing. She has chased and chased them and they eventually told her what has happened and they wioll re-instate her claim but they are unable to pay her back pay for the time when she has received nothing! She is in bits as this is her rent money - does anyone have any advice?

Incidentally she spoke to a manager who told her there was nothing they could do!!! Unbelievable.

You can make an appeal:

You have a right of appeal against any HM Revenue and Customs decision relating to:
  • the amount of an initial award
  • whether an award should be amended or terminated
  • the end of year decision on an award
  • amendment of an award following an enquiry or discovery of further information
  • amendment of an award due to official error
  • penalties and interest

Agreed.

Phone the helpline on 0845 300 3900 and ask for a 'how to appeal against a tax credits decision' leaflet.
