Default 3 Year Trigger - Incapacity

Hello,

This morning my mum got a letter from the job benefit centre saying she has to go for a three year review of her benefits at the local job centre as they want to "review" her, as it's been three years since her last check.

She is severally disabled. she's totally deaf. has very poor eyesight and no balance at all meaning she has to use a stick. She also has a Hearing Dog to assist her with her being deaf, and has a certificate from the social saying she's permanently disabled and that she is entitled to social services items and care for free.

Should she be worried? I mean she couldn't go back to work in her condition.

Hi Xign,

My mum (who is permanently and chronically disabled due to spinal problems) had the same letter. She is a trained nurse (or was rather) and was worried they would try to make her go back! So she rang and explained this to them.

She recieved a letter just before the 'appointment' to say that they had reviewed her file and she did not need to attend and her benefits would carry on as before - if you contact them on behalf of your mum perhaps explain her situation then all should be ok.

I certainly dont think they could reasonably expect your mum to work in the condition she is in.

300608 -Long running battle,threatening court, CCA letter NO 2 and harrassment letter sent - passed back to Littlewoods early July.
070808 - Passed to Debt Managers, Acct in dispute/BOG OFF letter sent 080808...
140808 - Letter from Debt Managers passing debt back to Littlewoods - RESULT!

Definitely sounds like nothing to worry about, as either a serious sight or hearing problem is enough by itself to pass the personal capability assessment. If they do try anything underhand, be sure to appeal.

Does your mother receive DLA? If you receive DLA higher rate care component, I think you are exempt from medicals and reviews- but the DWP often make "administrative errors" and call people who are exempt.

Give a ring to your local council welfare rights officer who may be able to clarify the situation on your mother's behalf.

Hey she gets Medium for care as she can still do household tasks but needs help getting in the bath or washing hair etc.

Thanks for all the advice I don't think she's too worried she's got some certificate from her GP saying she's she's indefinitely suspended from work so I mean they can't argue with that.

But it's just worrying getting the letter. Unfortunately they seem to question people with genuine disabilities and never question those who are falsley claiming!
