| | Basic Account Customer | DLA Appeal - DWP Submission is unreadable Hello everyone,
I'm a newbie and I'm hoping someone here can give me some advice.
I claimed DLA back in January and was refused, so I have started the appeal process. A very thick envelope came through my letterbox today containing the Tribunals Service Enquiry Form and the DWP's Appeal Submission.
The report written by the EMP is illegible. I know doctors are known for bad handwriting, but this is appalling! It's not helped by being badly photocopied, and I can only make out about 1 word out of 3. I'm supposed to read this and make notes about which points I disagree with, but how can I, if I can't read what it says?
Also included with the Submission is a copy of my original claim form and several typed pages that I included with it. There are also more typed pages that I sent to them as additonal evidence when they were reconsidering the claim.
All of these typed pages have photocopied very badly. The top half is only just readable, the bottom half is just a blur. As I understand it, this Submission is what has been sent to the Tribunals Service, so they also will not be able to read my typed pages. Should I send my own copies to the Tribunals Service when I return the Enquiry Form?
Is there any requirement that what the DWP has sent to me should be legible/readable/understandable? Can I insist that they send me a typed/printed copy of the EMP report?
Any help or advice greatly appreciated.

If not, get in touch with your local council welfare rights officer. They can assist you, including going to the tribunal with you, and are exceptionally good. |
