Hey people newbie here

i would be really greatful for some advice.

im 22 and living at home with my mum, im currently unemployed and my mum suffer from a spinal injury and unable to work so she gets incapacity benifit (which she should be getting disability but they wont give it to her)

as i am not working at the moment my mum gets housing and council tax benifits which i know she only pay a small amount.

here is were my problem start, i cant take full time work because i have duties helping my mum at home but i dont want to claim carers allowence because i want to work, i would like to know how much of council tax and housing benifits my mum would lose if i took a job between 16-30 hrs a week.

i think if i work under 16 hrs ( depends on the wage) my mum would still be entiled to benefits but thats not enough for me.

please can someone help me or give me information were i can get advice on this, i am keen to work but i feel very restricted to what is available to me, im sick and bored living on job seekers

You can easily get this info by calling your local revenues and benefits office-you dont have to give your name or address -they are paid to give advice !
Alternatively you can find this out from your local jobcentre or welfare advice agent.
There are online calculations that you can do too by filling out your information.
These days Councils encourage people to find out their entitlements-I am sure you will get all the info if you just ask for it.
Best bet is to ask an advisor when you next sign on-you will need to take details of your Mothers allowances and they can work out the figures for you.

next time i go down the job centre i will speak to another advisor, i asked my current advisor about it last week and she said i would be better off claiming carers allowence but its not really an option for me, and she didnt even have a clue about housing benifits.

at the moment i feel like a benifit scrounger because im able to work but my living situation is putting a hault on it.

You are not a scrounger you are a primary carer and as such this affects your availability for work. This is why it has been suggested you claim the Carers allowance because the State recognises (in many cases) being a carer is the same as having a job (although they don't pay salaries etc - only a Carers allowance.)

It irritates me when honest people are afraid to declare their circumstances truthfully and suffer because of this stigma and ridiculous attitude where they think everyone on benefits is a scrounger. The purpose of the benefits system is to help people in financial need because circumstances or ill health prevents them from working. You pay into the system and are entitled to take out of it. Claim what you are entitled to claim for your circumstances and do not be ashamed of this. Use the system to get yourself into a position where you can earn again and pay back into it. This is exactly what it is for.

Consider the claim for Carers allowance and you will not only help yourself, but you will also help your Mother and this in turn will relieve the State of a bigger Financial burden. Good luck.

As far as I am aware you can only claim carer's allowance once your mum is receiving middle-rate dla care. With regards to you to you working part-time it used to be based on number of hours worked per week but it is now based on the amount you earn and the amount I havn't a clue. For housing benefit as a non-dependant the calculation is based on your gross wages alone which seems unfair to me but them's the rules.

However if your mum successfully claims dla care at even the lowest rate and you go back to work your income is totally disregarded under existing rules. I suggest you telephone the DWP and order a dla application form (having checked with your doctor that he/she supports the application) my reason being that as long as the application form is back with the DWP within 6 weeks of the telephone call and your mum is successful, it gets backdated to the date you telephoned. I strongly suggest you get your Neighbourhood Office or CAB help fill the form in. Your doctor also has to fill in part but don't feel bad about that they used to get £75 per form and it may have gone up. So not a bad little earner.......

Yes - sallysas is right.

It's difficult to tell how much Housing and Council Tax benefit (HCTB) will be deducted as it depends on your earnings. The deduction may start from £7 to £8 a week from Housing Benefit.

I would suggest you to request a DLA form for you mother (08457 123 456) and get it filled by local CAB advisor or Welfare Rights who offer free service. There are two components of DLA; Care and Mobility. Care Comp. has three rates Lower, Middle and Higher and Mobility has two; Lower and Higher.

If you mother has walking difficulty and her walking ability is limited she may qualify for Lower or Higher rate of Mobility componant depanding on the distance, time, speed and the way of walking and help walking ourdoor (mainly unfamiliar places). If gets the higher rate mobility she can qualify for Blue Badge for parking and Motibility scheme.

If she has problems preparing cooked meal for herself you can ask for lower rate care comp. But if she needs help and supervision throughout the day and/or night she may get middle or higher rate care.

If she gets Middle or Higher rate care (or if your mother is 65 over then Attendance Allowance) then you can apply for Carer's Allowance (CA). I know you mentioned you dont want to claim CA but as long as you look after your mum 35 hrs a week (which I am sure you already do) and earn no more than £95 a week (earning from your own job).

If she gets any rate of care comp there will be no deductions from her housing benefit.
