Well I had a call from the housing benefit investigator who shock horror managed to contact the dwp investigator....they have decided to just deal with the periods I went back to uni 06/07 somehow they have decided they are not going back any further or investigating whether I got money from the LEA in April 2005, could that possibly be because they couldn't find anything as what I had been telling them all along was true...I didn't get any blummin money...idiots, yes I know they have their job to do but it didn't really take this long to get info on 06/07 so it is plain to see they were trying to get SOMETHING on me only to find I am actually truthful

So now I am having to wait for my interview which he said he will write me. I wonder how much longer that will take.....

Good for you SSE, a little bit of advice, although you prob dont need it, try not to lose your temper or let the wind you up and saying things that you will regret later (they will try) also make a list of the points that you wish to make and try not to get side tracked, then after the meeting write to them stating what you believe that the outcome was.

I will do my best though I must admit its gonna be hard keeping my cool with the head as she had no business informing social services when she knew what she was reporting was a lie, but hopefully she will learn one great lesson....it doesn't pay to be telling porkies

Just remember you have the moral high ground over this and they are pooping themselves and will be hoping that you DO lose your temper as they will then use this against you.

So the more controlled you are the more frustrating it will be for them

sweetnsexyenglish, have you contacted the local authority regarding a 'discretionary housing payment'. Different authorities have different forms and ways of applying but as you have an underlying eligability for HB then give it a shot if you already haven't. You dont have to pay it back and you could argue that because of the delay in receiving HB its causing you extreme hardship. Just phone them up and ask, they will know what you are on about. Also remember, HB is awarded if you are on low income, it is not linked to other benefits, so you dont have to be on income support for example.

Also appologies as I haven't read all of your post if this has been dealt with but the notice of possession, have they used grounds for this, for example ground 8 rent arrears or is it under the accelerated possession, section 21 if you are an assured shorthold.

Hi, the rent was backdated and paid two weeks ago leaving just a small amount of arrears which I am paying and the Discretionary Payments only apply to those on low income who's benefit dont cover their full rent looked into that one too. The Notice Seeking Possession no longer still stands due to everything else bring dealt with in that respect.

It is a long thread lol But thank you for your advice.

I have my appointments tomorrow with HB/DWP and my son's school so will update tomorrow on both of those.

Update: First I had my appointment in the morning with DWP/HB.....

I arrived for my appointment met by the HB officer who asked me if I remembered them to which I answered yes, he said I looked different to which I replied the last time I wore a cap but sarcastically I told him I have my drivers license so if he wanted to check it. The DWP officer replied, well it has happened in the past and the HB officer requested to see my id idiots. I should have asked to see there's as I found this rude as they are exactly the same officers that interviewed me the last time and if I can remember their smug lil faces....say no more.

They presented me with a transcript of the conversation which was 16 pages long to which I asked if I could receive a copy than reading all 16 pages now, however as the DWP was being awkward I took my time and instead of skim reading which I am more than capable of doing I read each page slowly one tape actually ran out before I had finished reading....during my time reading they whispered and when I criticised information in the transcript they especially the DWP officer rolled her eyes made faces etc including watching the time I guess meant to intimidate or hurry me... (transcript had obvious mistackes i.e. gave my middle name as something else and all my childrens names wrong, even had loads of erms mm and broken sentences which make it look like i stutter or found it difficult answering questions) so I asked for a copy of transcript and tapes...which I said on tape, was rude and unprofessional, she was argumentative and I also said on tape I will not be bullied harassed etc to giving the answers they want ME to give....all in all I stated my case I did try to get them to admit on tape the 2005 allegation they held up my case and cause my rent to go into arrears with threat of losing my home was dropped because their was NO evidence....they didn't want to admit to anything and spent their time trying to turn the question however they saw fit. Also on tape I let it be know their failure to provide information that would have alleviated the stress they put me under with my rent..... All in all I had never disputed the time when I was at uni however they tried to make it look like I got all this money and should have told them and implied I was robbing other people....

So I pointed out that should they check my in comings and out goings they would see that I was living from a monday - tuesday to thursday and I asked them what days these where....they played like they didn't know....

so I pointed out, yes they have a job to do and I have one to do also which is raise and feed and clothe my children, I have pawned jewellery, secured loans on my car just to make ends meet and my bank statement shows I had no savings I was not loaded as the money came in it went back out on bills and if they could also see time transactions of Internet banking they would often see I paid my bills the second the money hit the account often 2am 3am the money they assume is monthly is not so each time the money comes in I had sometimes up to £900 - £1000 to pay out which did not include my nursery fees which was £130 a week. I also higlighted if they looked at my statement they would see when no wages or uni money was going in I was not in reciept of benefit showing what I was living on when I was too ill to work.

They decided to charge me for receiving student money while on benefit however they said the decision maker will decided what I have to pay back what my punishment shall be i.e. what I have to pay back a week, if I am to get a caution or if it goes to court which is usually cases of over £2000.

They will have to do what ever I will not hang myself over the fact that even one dwp employee has already acknowledged, lea is worked out on the previous year budget and does not take into consideration hardships that are current i.e. current credit crunch, inflation or this years budget.
A few years ago my lea would have bought £200 worth of grocery shopping but since the last few years and rising debt all my LEA did was pay bills I couldn't even buy food or keep petrol tank filled up.

Now the school.....

I had a meeting with the vice chair of governors, the head was NOT present....I explained the whole situation to him and he said his duty was to investigate if the school acted appropriately and if the incident was reported properly i.e. how the original allegation became something else. He was made aware NO police had been involved and it was myself who called the police, he was made aware of the educational social workers that I had spoken with and the schools failure to acknowledge letters as they weren't aware I had put in a formal complaint to the school however I highlighted I had the school letters sent recorded deliver and have the receipts....I highlighted every issue I could remember on all concerns so now I have to wait.

However the person I took with me and also someone else that works with children believe the school acted badly and that the governors are aware of this....I dont like to assume so I will see what happens.

Just wanted to update and say on the advice of some good friends and my mother, I took some time out for me to de-stress and get my head together, got my head scan tomorrow lol the migraines have improved and I am actually feeling better about myself as well as eating better and sleeping better after everything that has taken place though the sore point in my life is DWP, and the craziest thing is I have been sent an appointment for a work focused interview for a benefit I am not getting, yet they have me down as being on income support but I dont get any money.

I never bothered to re-apply for DWP, I have learnt to live on £160 a week and would rather that than go back on DWP regardless of whether I am entitled to the money, I know pride comes before a fall but after the last few months of hell I wont give them the benefit of seeing me take their money.

I have even been offered to complete my final year at uni without charge after I put in a letter of complaint and someone took the time to look at how I have been treated especially since being ill since 2001 and I even got an apology. I not sure if I want to go back to uni as I am desperate to work and my family could do with the money or if I do I will go back part time as I also have to think about my health and the effect stress has on it.

But all in all things are looking up for me and my family and I doubt I'd have come this far had it not been for all the helpful advice received on CAG.

Wow, I have just read through all 7 pages, what a woman!

It just goes to show what you can do if you put your mind to it, I bet your kids are so proud of you (or will be in years to come).

What is your degree for? You have done the 2 years, and I know that the second year is the worst so you have done the hard bit now, just think of the wonga you can be earning in a years time, and I KNOW you will get that job lol! Seriously though, your health is the main thing so I'm sure you will make the right decision.

Thanks Midge, I'm having my first weekend away without children this weekend for the first time since forever lol I am sooooooooooooooo looking forward to it, I guess I am rebuilding a relationship with my mother which has come out of all this and she will be looking after the kids and I guess making new relationships of her own with the grandchildren. So all in all out of something bad good things are eventually happening.
