i recieved a letter from this lot this morning stating that they hold information on their computer that leads them to believe that mr x xxxxxx
still lives at my address and has done for the 4 yr that he hasnt been here!!!
i rang the person whose contact details were on the letter and asked where that information had arisen from only to be told that they are in contact with other "establishments", and they wouldnt say
it is infuriating as this is my husband and childrens father, and he has not been here since*/**/o4 when he was arrested and put on police bail for assault
ive been thru every bloo9y court trying to ensure that the kids remain in the only home theyve ever known and even involved caffcass for access as i was more than willing for him to see them, but not his partner as on her first introduction to the kids she nipped one of the twins and told the other that mum had never loved her
I wasnt having the kids' heads messed with and the only way to stop that was by asking for a police check on his said new partner and she refused and stated that she no longer wanted access to MY children
where do i go and what do i do??
this is just ludicrous

erm apparently i have 10 days here to prove that hes never lived here in the past 4yrs, what can i do? i have court papers for divorce, caffcass papers for access, police statements re his arrest, other than that proof via bank statements that i have paid all of the bills since him leaving, he pays via the csa for the kids and pays half of the mortgage and recieves discount from the csa for doing so (well did until 1st march when hes stated he wont be but????)
do i photocopy what i have and send or what?

yes it is not up to you to prove anything, ,but considering it has come from the revenue a strongly worded letter with copies of all the people you mention should make it clear and final to them (unless they are so stupid),they would still have to prove this was true it is really not up to you,
if you suffer any loss because of this then you have the right to redress

If you know his address honey, pop into the library and see if he is on the electoral role at that address. This must surely be enough to send them.
Also he must be paying council tax, something the revenue will be able to access but you wont, so they can easily check unless they are just another government department with orders from the top to make as much money as possible anyway they can, or want to do things the easy way and that would be to let you do their job for them.

This really is information that they can find easier than you can. They must be able to input his NI number and come up with a lot of details from their massive database (unless they have lost that in America as well).

ive a feeling this may just be where the problem lies, in that he hasnt paid any from leaving here until last oct when he moved into a flat by himself, Ive always paid it even when he was here it came from my account but was in his name with the council tax office, last october i recieved a letter saying i owed them?????????? it was on my bank statements that it had been taken from my account, and i spoke too a lady who "sorted things out" . strange thing is when he left i rang them to tell them and they have sent the council tax payments forms in my name since, its the only thing i can think of honestly

honey5, it sounds like your ex has been using your (his old) address during the last 4 years to obtain credence fraudulently, though I'm only guessing.
An example of this in my current shared house is of someone (previous occupant) buying TV/Video appliances using this address, therefore the TV licensing tried to chase us for non-payment (N.B. the retailers are obliged to make the purchaser give their name and address at point of sale).
Another example in my previous domicile, is that of someone obtaining bank accounts and credit facilities using several false identities beginning with a utilities bill in a false name - in this particular case I took advice from my local cop-shop and returned the correspondence back to the issuing banks and credit firms whilst keeping a log, although I found it difficult to openly lie to my formerly sympathetic neighbour and tell him that there was no mail for him and his false names, I had to do this to protect myself from being accused of complicity in his attempted fraud. What mail have you forwarded to your ex?

no mail forwarded in the last 2.5yrs as i redirected all of his mail from him leaving, it took a while at first to get it stopped but eventually after telling him everything was going back in the post with "not at this address" writen on it, he went to the post office and had his mail redirected himself.

Interesting. Maybe Hmrc could follow that as a line of enquiry by contacting the Post Office, because it sounds like firm evidence that he was living elsewhere, moreover - the PO should be able to supply his address.
