Default 7k tax credit overpayment - they made mistake

Hi,
Wonder if I could get a bit of advice re this.

Two years ago I was accused of providing false information to the Inland revenue and receiving over 7k in payments that I wasn't entitled to. The accusation was that I had told them that I was disabled, when I had in fact told them that my daughter was classed as disabled. I received an increase in my payments and made the assumption that it was correct.

Each year, I confirmed the same thing, that my daughter was classed as disabled, and I queried entries made on my award notice.

When I received the letter stating the above, I went to the CAB, who advised me that I did not have a leg to stand on, it was my error and not the inland revenue. A letter was written to them and the same response came back, I now have benefits deducted from me at about 100 per month, which is alot of money, considering I didn't make the mistake. I have just read an article link from this website to the Times newspaper that states errors were made by the IR staff and millions might have to be returned to claimants, is there any letter templates or guidance to do this

Perhaps obtaining a copy of your original paperwork would be a good place to start, assuming that you told them in writing that it is your daughter that is disabled. HMRC are after £800 off me which I dispute so I sent a S.A.R and requested copies of everything - they sent me the £10 fee back though.

My brother was charge with giving false information and they expected him to return 19000.00 they said that he had not told them he had stopped childcare when they phoned him to check there was no change of circumstances he said he had answered each question as asked fully and truthfully and asked for a copy of the phone conversation as they are all recorded .( apparently) they could not give him a copy ( lost apparently ) so his solicitor had the who thing squashed for insufficient evidence as for a copy of all phone calls if your claim was done over the telephone
