She should have checked her obligations, and the tenants rights, before doing anything. Whilst on the face of it it appears ridiculous, these laws are here to protect tenants and this landlady has wholly ignored them.

Setting aside the reason he left, i'm afraid i've no sympathy for this lady either.

Well I am sure that she knew that there was no way her tennant would be coming back and she has been paying for the storage of his goods, just seems bloody ridiculous, hardly an eviction if he is banged up for life eh?

Not to me. He has paid the tenancy, and signed up for a fixed term. Actually whether he is resident in the property is immaterial. Also, you cant exclude this from the law, without excluding a LOT of others. How do you prove you knew someone was locked up? Excluding this because you know he wont be returning opens the door for ANYONE who the landlord deems to have abandoned the property to simply kick them out following no due process.

If you think that is ridiculous, I have recently been dealing with a client who is evicting a tenant who has died!!! But we still have to follow the process, and there is good reason.

Well yes that is obviously in effect what we are doing but just illustrating the point - especially considering that there are no actual residents of the property, so it is not as if we are physically evicting ANYONE.
