I haven't, despite the fact that all evidence unearthed showed it should. As the officer's decision is final, with no information given as to who how that decision was reached, there's nothing I can do about it. Sucks.

Can you not complain to the LGO or ask them to investigate?

Surely there must be an appeals process?

Well I think you might be out of time (possibly)

If someone disagrees with a decision made by a listing officer they have the right to appeal to a valuation tribunal.

The only problem is that the appeal has to be made within 2 months of notification from the local authority of their decision, or if the local authority does not respond, within 4 months of the initial complaint. It does state that out of time appeals can be allowed in exceptional circumstances.

I think that the fact I was told there was no right of appeal may well count as exceptional circumstances, I certainly would give it a try.

Ahhhh, hang on, I think we may be on different length waves, re-reading your initial post, I just noticed you said your "new" house... If I remember rightly, there was a difference between a new occupant challenging the banding and people like me who have been there for years.

That's true.

My information states that a new occupier has six months to register their request to have the band revalued.

yes

some time ago we managed to have our house moved down a band - by using the house prices on land registry for houses sold in the area at the time of valuation.

However I am more worried about our situation now.

We purchased the house in 2005 and it is definitely in a band below what it should be as it has had a large extension in 2002. We were told that houses should be re-banded when sold - but when we wrote to the council inviting them to visit - we heard nothing ( they obviously know about the extension as they gave planning permission

I wonder if they re-valued could they back date the charge

sorry did not mean to hijack your thread

Jan
