New to this but very interested in what has been said so far. Due to my inability to balance my accounts I have had to enter into an IVA (1 year ago), prior to this I was with Barclays for about 20 years. Would it be advisable for me to contact Barclays and get my statements from 1999 as I think nearly every month from then I was charge for either bounced Direct Debits or unauthorised overdraft. I realise whatever funds if any i get back will be swallowed up by the IVA (or part of it) however these charges made life unbearable and was a contributing factor for me nearly declaring myself bankrupt.

hi qball I pretty much went by the step by step guide in the FAQ's, went to library on this site, found the first approach letter, in which I requested the charges back, when I received the reply sent the letter before action which is in the library also. Was offered the 50% letter after I posted the first approach letter using the freepost address at the top of this barclays section.

I am just trying to figure out my moneyclaimonline statement, have found the rough guide but do not know when my bank contract is dated for. (The first line of the guide).

ok have found another rough guide lifted from penaltycharges.co.uk, as follows

The defendant from date to date has applied Penalty charges to my account,

totalling £-----

Notwithstanding I am in the view the defendants charges represent a penalty and

therefore are irrecoverable at common law. the precedent for this was dunlop

Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd (1915) AC 79. along with

Murray v. Leisure play (2005) EWCA civ 963 It was held that a contractual party

can only recover damages for an actual loss or liquidated losses.

Notwithstanding I am in the View that the Defendants charges are also contrary to

the Unfair Terms in Consumer Contracts regulations 1999. Subsection 1(e) of the

said regulations gives a non complete list of terms which may be regarded as

unfair, such as a term which require me as a consumer who fails in his

obligation, to pay a disproportionately high sum in compensation.

I believe that the defendants charges require me to pay a disproportionately high

sum.

Therefore I seek to recover all of these charges from date to dat plus interest a

total of £-----.

what do you think is the above ok for moneyclaimonline? advice welcome

I recently complained and got want I wanted very quickly without any hassle.

I got a refund (not these unlawful charges - regarding another matter/dd mandate problem).

It was resolved in less than one week!

Also,I received a letter of apology!

A matter of fact I was VERY impressed and shocked!

Accordingly,I thanked them for assisting me in a very professional manner.

JUST REMEMBER...

IT PAYS TO MOAN!

Icefall,Im reading this thread with intrest and, as a barclay's customer, would like to know if you sent the original letter out of the libary, the one about the Data Protection Act, or did you just ring them up and ask, quoting the Data Protection Act material?.

Because if so, then i will start to recover charges back.

bigjeff I just rang them up and asked for them under the Data Protection Act, it seemed an easier and quicker way to ask, the guy I spoke to just said yes straight away 5-7 days delivery, £5 for statements. Once I had the statements, I sent the first letter to them.

I got the number from moneysaving expert from the very long thread this is a link for the get a human database, its a list of companies and insructions on what to press to get straight to a person

just to let you know I received the acknowledgement letter from the court today, the bank have put a cross in the 1 - I intend to defend all of this claim box as opposed to other 2 choices. I assume that is standard
The person signing is their inhouse legal executive, just a point of interest! Spose its time to wait now for their defence?

chomping at the bit now, this bit takes a few weeks doesn't it...

any advice please post cheers
