My previous 4 calls had me waiting on hold for 16 minutes - only to be passed to 2 different depts. Then told to leave a message - they got back to me the next day and said my statements were being rushed out that day and I should get them in the morning - that was 5 days ago!

So now I refuse to call and chase them up - I will wait, bide my time and screw them for every penny I can!

Moi angry - naaaaaa

Ah... Moneyhelp... still no statements eh!!

Roll on Wednesday... Don't forget to add some amount for damages and distress... all those calls and time add up.

I put £150... noomill060 put a claim for £200 damages + court fee and got an out of court settlement for that amount along with his statements.

http://www.consumeractiongroup.co.uk...ct-access.html

He was messed bout the same way we are being messed about. His thread is certainly worth a look.

Still no statements.

Called the number they gave me last time - 01604254518 Data Protection, it's always on answer phone, left a message to get back to me.

Printed N1 and POC for non compliance and exemption forms ready to go tomorrow.

Just got a call from Data Protection team saying my statements were sent out on the 20th June, this was also the day I sent out my LBA. She said that they must be lost in the post as it is on my file that they were sent that day.

She now cannot do anything as the lady that sent my statements has gone home. I have been assured I will get a call in the morning and "probably have my statements then too"

I am still going to file my N1 at court tomorrow as I know I wont have all my statements.

Call from Barclaycard this morning - 'statements were sent out 20th June and they will not be held responsible for Royal Mail loosing them' - I do not beleive Barclaycard even sent them.

They are re-sending them today and the ones they sent yesterday were 'handed to Royal Mail last night'

I don't know wether to wait before I put my N1 in or not. I'll wait until the postie has been, then decide.

Question Re: Moneyhelp Vs Barclaycard

Received statements for dates June 2004 - Present (dated 20th June)

Usual letter...
Quote:
the others are stored on microfilm(rather than computer) and take more time to search and produce.
Statement requests are being processed in order in which they have been received to seek to ensure fairness. The Data Protection regulator, the Information Commissioner has been made aware of the position and knows that we are writing to you in these terms... blah blah blah... we do not consider that the microfilm statements fall within the scope of the Data Protection Act 1998. Nevertheless, we are happy to provide these as a gesture of goodwill.
So what I want to know now is - what do I do about my N1 for statements I filed yesterday?

Do I cancel it or let it run until I get ALL my statements?

Typical isnt it you waited and waited bet you did not know whether to curse them or be glad you got them.I would keep in the N1 claim as you not got the Microfiche stuff yet, then when you do you must be able to claim the fee back.

yeah... wait until you have got everything... and then bill them for wasted costs.

Also double check them when you get all of them.. make sure there are no duplicates or blank 'zero' ones...!!
