I thought it was rather a tame letter, more like ballet silks than size 15s

Perhaps a very simple email to KJ suggesting he contact me for possible settlement?
After all he doesn't have my phone number......

I think you have already tried to resolve it by writing to them before taking court action. I have not heard of anyone contacting the banks at this stage, but I do not claim to know everything, or to have read all the threads, particularly in the Barclays forum.

My best advice would be to go back to the FAQ's and the step by step instructions and check what they say there. I do not have experience of the courts, other than having just completed my first MCOL claim, so I will be following the instructions exactly because I know that hundreds of people have got there money back using these methods. I cannot afford to deviate from this and risk losing my claim for my bank charges.

I am amazed to learn that people are contacting the bank's solicitors with this kind of thing.
Is it only Barcalys or is it all the banks?

I really do not think it wise to approach the bank or any one else in the way you outline, just follow the steps and templates but read up and be aware of all the info and have an understanding of what you are doing.

I have contaced banks and other institutions over the years and really they have been virtually pleading letters but have never had a postive response. I recently recieved a letter from a secured lender marked WITHOUT PREJUDICE inviting me ring them as they wanted to help. I would not touch it with a bargepole.

When a letter is marked WITHOUT PREJUDICE this means it cannnot be used in any legal claim, is that right?

It means it cannot, without permission of the Judge, be shown as evidence in a court. Take the documents to court, and if your case is going badly, explain to the Judge that you have documentation received without prejudice which may affect the court's view of the case, and could you please bring it forward? Unless he can see a real swing to the case occurring he will generally refuse.

thanks, not at court action stage but in time I may be so need to keep up to date. I have interpreted their letter as lending against property again which is bizarre when I have an arrangement and a default?? sorry not hijacking this thread, you know what I do think twice about what I am prepared to write these days, silly maybe.

I received my normal monthly bank statement today and the address for correspondence on there is:-
Barclays Bank Plc
Leicester
LE87 2BB

Im thinking of taking a copy letter to my local branch would this be advisable.


I hope this may help with the addresses situation.

Mr P T was quite quick with me for intial files etc statements followed, around 3 weeks from my original request and after he tried toi delay things. But originally I sent all info to Sharon Caffery the Subject Access Officer and she seemed to get PT moving.

Now I am dealing with the Senior CS Manager in London, much further up the chain of command he he...don't worry guys you will catch up soon!!!

You would normally get just over 2 weeks to respond to the AQ, so the bank may have dragged its heels a little. Notification normally comes a few days later.

If you like, give the court a call and ask for an update....
