Hi, This claiming charges back was brought to my attention through a link someone sent as a general email so I thought I'd take a look.
Knowing my bank have slapped these charges on my account I thought I'd have a go at getting some of it back.
So here I go, I have calculated the amount taken over the last 6 years after a simple request to have all records sent to me.
I have two accounts I am claiming on and have submitted them as a single claim [hope thats okay]
I have used the standard notification letter to inform the bank of my intentions and attached the two spreadsheets with the amounts in question.
Personally Im not bothered about the interest accrued but if they pay it out that will be a bonus.
Just the charges alone amount to £1385.
Annoying thing was, when I received the statements, in the same post was a letter of a further £30 charge! Why dont they just stop charging this stupid amount if they know people are on to them?
Just got to wait and see what their reply is now.

by the way, my charges are listed as different things through the 6 years, they start of as 'Unpaids Out', then 'Unauth O/D Fee' and more recently 'Paid Referral'. Are these all submittable?

fingers crossed, the missus has already spent the money LOL

Yes.
Single claim is fine. Further charges can be added right up to filing at court.

Okay confused now, got the letter to send off but where to?
Does it go to my branch address or the Head Office in London?

i suppose it doesnt really matter, im going to send it recorded so they cant deny receipt but if it goes to my branch only to be forwarded after a number of days sat on someones desk then its more delay, I want to hit them hard and fast. GGRRrrrrrrr!!!

I also came across a thread with a zip file attached to help out with the court bundle preparation, cant find it now, anyone got any ideas?

Branch is fine.

Court bundle is not needed until you have a hearing date, which is some way off yet. However it is listed here:

Hi guys, update,
I received a letter from Barclays [Mike Brophy, CR Manager] stating they are unable to reach a decision within my timescale, they state they will reply within four weeks or reply with a letter stating why there is a delay.
Do I continue with my course of action and send my second letter, 'failure to respond' after 17/01/07 which is 14 days after they received the letter or wait for the four weeks?

oooh also, my claim is for two accounts, my recent letter only refers to one, does that make a difference, do they need to acknowledge my claim for both?

Letter received today, 11/01/07 dated 09/01/07, [6 days after receipt of my initial letter], stating they disagree but as a goodwill gesture offering £720.

I am returning the offer with a thanks but no thanks, am i right in saying i write as, I accept your offer of £720 as partial settlement to my claim to recover charges but will be continuing action to recover the remainder....

any other advice is welcomed before i commit myself,

Typical reponse so just send them the rejection of settlement offer from this site and, when time's up, the LBA. Seems to be going fine for you.

I happened across this site and it resulted in £2500 +. Don't knwo what point you were trying to make there!

I was just thinking that it's funny that people fall upon the site almost unknowingly and a few months later walk off with a tidy little bit of cash (admittedly there's to start with) and there aren't many places on the Internet that actually get you money!

This is my reply to their offer:

Thank you for your letter dated 10/01/07
I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account as stated before

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

My letter before action sent previously indicates that you had 14 days to respond before Court action commences. As you have responded in a positive manner I will respectfully allow a further 14 days for you to reconsider. You are reminded that there will be no extension to this timescale and if the situation is not resolved by 25/01/07 then I will continue my action to recover the amount

I trust this clarifies my position.

letter received today dated 15th Jan,
i am sorry you remain unhappy..blah blah blah......
£720 was a goodwill gesture and we will not increase it.........
It would appear we are unable to reach a mutually acceptable resolution.

basically saying thats it, take it or leave it..

Do I go to MCOL now?
anyone got the link and tips on whats next?
